over $500 you should have a contract. sounds like you do.
contracts are (esp in VA law) "assume in good faith" , anything not spelled out on paper is assumed in good faith. it is that simple.
over $500 is civil court last i heard (proabably should be $5000 with obama inflation)

it's your responsibility to hold on to your money (by hiring reputable company , ie, not f'ing foreigners)
probably if you won in court they'd get the opportunity to fix the work and elsewise you'd have the right to have someone else do it at their cost.
you can't decide to hire someone else and "make them pay" , no only AFTER a ruling can you "make them" do anything
