Small Claims Question

Myself and several neighbors are trying to amicably resolve an issue with a contractor for services which have largely been paid for but not delivered. If the contractor is unable/unwilling to finish the projects we are considering hiring another company and then trying to recover that additional cost estimated at $700-1000 through small claims court.

Would we be able to file as a group, or would we need to do this individually? The material on the Fairfax District Court reads as if a plaintiff is a single entity.

If he is licensed, You have other recourse. Check the State Corp Commision and work from there.

If he's a local contractor then follow him at the end of the job and see what he does to avoid paying the illegals. Catch it on tape and you may have some leverage over him.

over $500 you should have a contract. sounds like you do.

contracts are (esp in VA law) "assume in good faith" , anything not spelled out on paper is assumed in good faith. it is that simple.

over $500 is civil court last i heard (proabably should be $5000 with obama inflation)

it's your responsibility to hold on to your money (by hiring reputable company , ie, not f'ing foreigners)

probably if you won in court they'd get the opportunity to fix the work and elsewise you'd have the right to have someone else do it at their cost.

you can't decide to hire someone else and "make them pay" , no only AFTER a ruling can you "make them" do anything

MY ADVICE IS

fx co courts are corrupt as all hell. if fx co execs. have shares or even agenda in supporting the company: your screwed

the county will try to tell you to complain to the BBB or the agriculture dept. THAT IS A DELAY TACTIC - you might miss your time window. commerce matters are legal matter has been for 2000 years +

the county will try to instruct you to spend a shitload on lawyers and spend years arguing. DO NOT

For 700-1000 among several neighbors, I would just cut my losses and bad mouth him/her every chance you get.

What services and materials have been paid for, and what remains to be completed and paid for? 700-1000 dollars is roughly a day's labor for a skilled contractor.
