rock from work truck on I-95 hit windsheild, will the state pay for it?

Does anyone know if you can get compensated for this or how to do so? I wasn't able to find anything on the DMV Virginia website. It was one of those "work vehicle do not follow" dump trucks that spit a big rock up at me, I actually saw it. But how do you prove something like this?

My auto insurance deductible is more than the cost of replacing so that route didn't work. Anyways, out $280 here.

Did it fall from the truck or get kicked in the air by a tire?

Fall from truck- if they didnt have it covered and you got the tag number etc, you should be able to collect. Did you run the truck down after it happened and tell them? If not you could be fucked.

Kicked up from road- no liability, youre out $280.

I don't know if it fell or was kicked up, this was a few weeks ago right after a snow storm, reduced visibility, shitty road surface, etc. I saw an object coming in my direction from the truck that hit my window and we were both moving 40+mph so I know it came from the truck. I don't have the tag number.

This statement alone would get your lawsuit instantly dismissed in any court.

The rock has to fall from the truck due to the driver's negligence in properly securing his load in order for you to have a claim. Otherwise, it's considered a road hazard, and you pay for the windshield replacement (or your insurance does, if you have a decent insurance policy).

As Legal eagle eye said, if the rock fell off the truck, the trucking company pays: if it was kicked up by the truck's tire, you pay. This is well-settled case law in the Commonwealth.

Fuck, Everyone who pays a Fairfax County tax on their car should get a refund because of the fucking pot holes on the roads in fairfax..My front end and tires are fucked because of the shitty roads in Fairfax..

Big mouth, little knowledge.

If it was a dump truck, chances are it is a small company, or chances are even better it is an "independant contractor" and the company he drives for will tell you that adamantly and refuse to help.

This is a big part of the reason they hire "independant contractors". Even if the truck has the companty logo on it, I would bet he is an contractor.

And try collecting from a contractor. I dare you.

obviously yes. trucks get a moving violation if they carry rocks in their tires leaving the construction site

and you can ask your insurer what to do

and only an idiot would not write down the name of the truck company and think they are going to be paid
