RICHMOND, Va. (AP) -- A University of Virginia student is seeking $40 million from the state and seven Alcoholic Beverage Control agents who arrested her believing she had illegally purchased beer when she had bought bottled water.

Media outlets report Elizabeth K. Daly filed the lawsuit this week in Richmond Circuit Court. She alleges malicious prosecution, six counts of assault and battery and failure to appropriately train ABC agents.

On April 11, 2013, ABC agents confronted Daly outside a supermarket in Charlottesville. The agents believed Daly, who was then 20, was under the legal drinking age and had purchased beer.

Daly was charged with two felonies for grazing two agents with her vehicle. The charges were later dropped and expunged from her record.

Yeah I feel like in this kind of a lawsuit your request for damages has to be reasonable. Unless they burned down a half a million dollar home stocked with all the newest, priciest appliances and gadgets there is NO WAY she's getting 40m.

If you read the story when it happened, it was clear what a bunch of douchebags the ABC agents are. They should all be fired at a minimum. Ideally, they'd also be held personally liable for damages rather than us taxpayers.

She doesn't deserve 40 million, but she will get something and it should be paid out of the ABC's pension fund (if there is one).

Did you read the original story involving this young woman?

I feel as though $40 million is fair, after all the legal issues she suffered from, plus the abuse and negligence of the police.

It will send a strong message to law enforcement who try to ruffle their feathers.

My solution would be the state pays her legal bills and reimburses her for her tuition for that semester, plus the value of the stuff she bought at the store. Each agent involved in the incident then personally pays one month's salary to her, to be delivered in person with a written apology. It will never happen but it would send a much bigger message than any six or seven figure verdict that a jury hands down and the state's insurance pays.

Ask for 40 million and get 20 million. It is the jewish way.

Max payout by State Law can only be 100K. if suing the State only.

Remember the VT Shooting, no one got much $$$ out of those suits.

There is a difference between actively harming someone (as in the case at hand) versus passively not saving someone (as in the VT shooting incident.) I hope the courts have the common sense to know the difference.

In total, she should get legal fees + 100k.

Not $40 million...

How is she proving $40 million in damages? Is she some high priced lawyer that would make $40 million in her life time and claims she now can't get into a law firm.

A judge will laugh this one out of court. You can't just pick a random number out of the sky. You must prove every penny of damages.

A friend of mine is a lawyer for insurance companies. They get outrages claims like this all the time. The first thing they do is hire a private investigator to dig up everything they can on a person. They then dig up all past court claims, tax filing and assets information.

Oops you slipped on the Safeway floor and you want $10 million. Ok let's see your tax returns that show you would make $10 million if the injury is stopping you from working.

She was awarded $212,500.

212k maybe 70k after taxes - sounds a little low but at least its something. The issue here is not harm to her per se its the abuse of police power. That abuse is, in my opinion one of the most serious to be had. ABC made a mistake busting her for water but the BS 'grazed by auto' lie was an attempt to punish a citizen by making a false claim under color of law - I think she should have gotten more $$$ to send a message.

thanks for posting the Complaint - interesting reading. Basically a bunch of ABC a-holes screwing up, acting like 'Cops' from TV then prevaricating to the magistrate to get warrants issued. After reading the complaint I would say she deserved a lot more than 212k. the 70k after tax wont even cover her shrink expenses and tuition for this year let alone the future.
