Passing stopped school buses on Little River Tpk

So this morning saw several cars speed by a stopped school bus with flashers on and stop sign out. This was down the street from Woodson, before Roberts Road. We see this a lot at that location. We need to fine these people.

Since that is a divided highway, unless the vehicles were "overtaking" the stopped school bus, there is no prohibition from. Passing means they were going in opposite directions and if on a divided highway, they do not have to stop if the school bus is on the opposite side. However, if they overtake the stopped school bus on the same side of the road then, they are comitting a moving traffic violation, and in this case I believe it's a Class 1 misdemeanor, which can include up to 1 year in jail and (not certain about this) $2500 fine.

Excellent post. A divided highway means any state owned road with a median. Traffic going the opposite direction is not required to stop. Vehicles doing so could possibly be considered obstructing traffic.

However, if they passed the bus in their lane of travel then they deserve a nice, hefty fine.

They were overtaking at speed on the same side of the road as the bus. We were on the opposite side with no need to stop.
