Owned at court Fairfax Court
Posted by: joe Brown ()
Date: March 13, 2014 08:05PM

The Judge threw the book at me. I was doing 89 in a 55. I was sentenced to 10 days suspended jail time, 6 month suspended license and a 1500 dollar fine.

Of course I am going to continue to drive even though they physical took my license. What are the chances of me getting pulled over If I drive the speed limit? Can the police tell that my license is suspended if they run my plates if I'm sitting at a light? Does a police officer have a right to stop you based solely on running your plates?

Thanks for the answers.

P.S never go in front of the judge, Take the plea bargain. Bad mistake today

So you proved youre a dumb ass. Congratulations!

And now to reinforce the fact that youre a dumb ass, youre going to make sure the jail time gets reinstated. Brilliant?

I guess if you want to live dangerously, you should be ok. make sure you dont have a tail light burned out.

I got my license restricted for 1 year and of course needed to drive places other than work.

I just used my GFs car for the year and was fine, just make sure you drive slowly, and check your lights every month to make sure everything is working fine. Avoid being out past 12pm.

As for your car, I would not drive if it is registered under your name. They ALPR (automatic license plate reader) will scan your place and then you are fucked. So as long as your plates are clean, you are golden.

I did receive a restricted license. But the car is in my name, Will the reader pick up that i have a restricted license. Is that enough to pull me over?

It depends what time it is, and where you are at. I would try to find clean plates and not risk it.

If you really have to go out, make a B.S work schedule, and keep your work uniform in the car with you. If you are cool with your work manager let them know the deal so if the cop calls them they can say "yeah he is out on work related duties etc".

Good luck, 6 months will pass quickly, just be careful out there.

Yes, police routinely run plates of everyday traffic. If they look up your plate and you're outside of the zone defined by your work commute, they will pull you over.

With LPRs becoming more and more common, you really can't get away with driving on a restricted anymore.

Also, you better hope no one bumps into your car. Driving on a restricted = automatically your fault if you are not going to/from work..

I drove anyway; every day, everywhere...for over three years.

Never got caught.

Its a different time now. Back in the day (late 80's) i got popped for suspected DUI ( I was hammered) and the cop let me drive my car with 2 passed out girls in the back, and followed me back to my apartment. He ended up giving me a ticket for Failure to Obey a Highway Sign (no points, not a moving violation)

You get stopped with a suspended license now, you go directly to jail and whoever's car you are driving is impounded.

I meant, by renting a car, using a loaner car, or a friends/family car. Stealing plates is stupid, especially in this day and age. With all the ALPRs out there, you would be fucked real quick.

Who's going to rent you a car with no operators license you moron?

And im not loaning you my car either. Great way to get your car impounded with a hefty fine.

It's not worth it. You might get away with it but if you get caught you'll get a whole new set of charges, fines and likely jail time. Ride or bike or get a bus schedule.

Restricted license* So you still have a license, it just has 3 - 4 letters under the restrictions section. A restricted use drivers license is still considered a valid drivers license.

As to who will give you a car when you have a restricted license

From my experience,

Audi of Arlington
Hertz
My GF

But back to the OP.

Borrow a car, or better yet, just wait 6 months. 6 months will pass before ya know it.

OP said he had a 6-momth suspended license, not a restricted license.

Yes, your plates will be scanned and the police can and will pull you over.

Then you will go to the ADC where you can gain new friends and post more about your loser life here.

Thanks

I got up to two years driving on suspended license before I finally turned 21 and realized I couldn't go on without an ID.

Those ALPR's they have around these days will get you quick. I don't think I'd try what I did back then today. OP, don't take your chances.

There used to be an outfit called Rent-A-Wreck in Manassas I think. If they still exist, they might. But be prepared to pay a fortune for a POS.

it so happens the judge has to follow the law and can be prosecuted for intentionally not doing so, as a person. so jot down his name and home address you might need it to sue him.

the penalty must fit crime

justice is blind. for all i know that penalty did fit your crime

i forgot. often speeding is a TORT, a citation, not a crime

speeding in itself is NOT imprisonable. no.

however i you do intentionally speed in a dangerous situation that could be a crime - for example if you were speeding next to a crowd of people - that is criminal

everyday speeding does not pass snuff as criminal behavior.

--------------------

possibly if you repeatedly did it, you had no remorse or sorrow for having done so, the penalty would be stiff but not necessarily criminal

you might be kicked out of town for it though as for being someone who was reckless with over $2000 and of injury repeatedly without remorse or apology. the town does not have to permit that.

Simply because a vehicle is owned by someone with a restricted license is not probable cause to pull over the driver.

The police can not pull over a car solely because of something about the car's owner. Think about it. The owner is not necessarily the driver. If they know you and recognize you then they can pull you over. Otherwise, no.

In 1981 I was stopped by a cop and failed a field sobriety test. The officer thought I was a bit tipsy, so he told me to drive half a mile to a 7-11 & get some coffee. Afterwards, I drove 2+ hours to my destination.

In 1984 I was stopped by a cop and failed a field sobriety test. The officer decided I was too drunk to drive, so he drove me to the police station and had me call my boss to come give me a ride home.

It was a different time.

Yes. If a cop is in traffic just running plates and the car is in your name all of your driving history comes up on the computer. If youre suspended, restricted, etc and you match the description of the driver the cops have probable cause to stop you. If it's not you they will probably tell the driver to have a nice day, if it's you, well, you guessed it, youre fucked!

The OP (still driving) and people like you are a great example of this douchebag generation. Rather than facing your punishment, learning from it and not doing it again, you immediately go back to what got you in trouble in the first place and shamelessly so.

Is six months of not driving worth risking your freedom over?

You missed the point. There is little of losing freedom. I appeared in court to get a fix-it ticket dropped. Shithead after shithead was going up there for driving on a suspended license, getting convicted, and walked out free to do it again. What do you have to do to get arrested around here? Drink water on the metro? I know we all have better things to do with our time, but attending traffic court will show you how insignificant the OP is in the big picture.

Sure, the OP shouldn't be driving that fast and shouldn't be driving on a suspended license, but I really don't see enough consequences to deter him. The county makes money with fines, loses money with incarceration, and breaks even with unpaid fines without incarceration.

OP said he got ten days suspended jail time. If he gets caught driving illegally from here until his suspension is over, won't he have to serve those ten days?

I'm guessing then he would finally learn his lesson but I wouldn't hold my breath.
