I-66 ticket for changing out of HOV lane non-hov hours

So on 66 minding my own business heading west from the beltway. Its non HOV-hours 9:30. Go into the HOV lanes to pass someone go back into the left center lane using turn single. Next thing I know I'm pulled over for improper lane change. Apparently they have those new solid lines on HOV where you can only change at certain times. I'm thinking to myself but its not HOV hours. You mean to tell me the far left lane of a major expressway is limited access 24/7/365. Are you kidding me?

The ticket is only 30 bucks it's not worth my time to go to court. But I'm curious is there any legal precedence for a violation like this during non-HoV hours?

Apparently the infraction isn't even a state issue. Its a Fairfax County issue.

I personally think HOV creates more traffic problem than it ever helps. We have highways that don't get used, bottlenecks on roads that aren't designed to carry the spillover traffic, lane confusion, millions of dollars spent on this garbage idea, etc.

Some people just can't carpool, for many reasons. Variable hours, hours they can't control, etc.

Those solid lines at the Nutley and 123 interchanges are at least a year old and you are never allowed to cross them to change lanes, whether it's HOV time or not. There are signs on the left as you approach them that say so.

You can blame VDOT for this. Those solid lines are one of their many idiotic ideas to improve traffic flow. In reality they accomplish absolutely nothing other than wasted money. (Which apparently the government recoups by giving ridiculous tickets to people who change lanes over them.)

Nothing you can do other than keep a closer eye out for coppers.

"7. Whenever a highway is marked with double traffic lines consisting of two immediately adjacent solid white lines, no vehicle shall cross such lines;"


A single SOLID white lane line indicates that crossing the line to change lanes is discouraged, for example when a separate turn lane is provided.
A DOUBLE SOLID white lane line indicates that it is prohibited to cross the line to change lanes.


Single solid white line = legal
Double white = illegal

Yep, that was my point - a solid SINGLE line can be crossed, white or yellow

Yellow lines separate one from opposing traffic. White lines are generally to your right (shoulder). However, in this case, they are lane division lines, and can be crossed, but "discouraged".

66 HOV has double white lines, so it is illegal. OP broke the law, just pay it.

I cross over those lines pretty often, usually someone going to slow in the left lane. Just watch out for cops when changing in and out.

i had a black officer give me a gov ticket when i as a minor

thing is i was lost and on my way to HS exams and had no other way (my carpool i'd always had was missing that day) - so she was causing truancy

it was a double I broke the law and am paying. Its 30 bucks

I agree its a nightmare for traffic flow

Like many things in government an idea that looks good on paper doesn't always work well in practice

and yeah I was going around traffic to make the change

cop should have pulled the other guy for going too slow in the left lane maybe I should make that guy pay the ticket haha

also ironic it was the end of the month.... but I digress

I-66 is always a clusterfuck, thanks to the birdbrain idiots at VDOT. Traffic would flow much better if they eliminated the mindfuck lane shit and just let people friggin drive.
Why bother with the signal-controlled lanes? When the lanes are "closed", drivers coming off ramps either ignore the signals or suddenly realize they're in a bad lane, and force everyone else to stop to let them in. Constant backups are the result. Can you imagine how fucked you'd be if, god forbid, you ever used that lane as a shoulder for a car emergency? You can be certain someone would ram you from behind at 60mph.

Someone in our office cafeteria was mentioning recently to his peers that his girlfriend was cited for 5 infractions on I-66. Speeding, crossing the solid White lines, changing lanes without signaling, passing on the Right and I think the other offense was either tailgating/following too closely, or may be pulling too close in front of a moving vehicle, if there is a law against doing it.

Apparently all she did was pass a slower driver who was in the left most lane, LOL.

HOV has nothing to do with the ticket you received. By your admission, you CROSSED A DOUBLE SOLID LINE! That is an illegal lane change.

Don't rely on this thread, you need to pick up a copy of the VIRGINIA DRIVING MANUAL (or any state) and study what all that paint on the road means. It sounds like the original poster has a lot of studying to do to learn to drive safely.

You CAN use all lanes during non HOV hours but you MUST enter the lanes where it is marked to do so! You CANNOT just cross double lines because your feel like it.

Try crossing the double solid lines in the Baltimore tunnels, and they will replay the video in court if you (or the prosecutor) would like to see it.

One thing that is stupid on I-66 is Westbound before the Vienna exit. There is a sign that says BEGIN TO EXIT HERE (in other words, you can move off onto the shoulder, which is now an exit ramp.)

About 500 feet later, there is a red X over the same lane that the sign invited you to use to exit. WTF.

Interesting issue and question.

I495 Northbound heading into Maryland there is some sort of construction project going on and most of the white stripped lane divide markings have been repainted in the past few seeks to double solid white lines.

I was like, WTF is going on here.

Read line 7 - "7. Whenever a highway is marked with double traffic lines consisting of two immediately adjacent solid white lines, no vehicle shall cross such lines; "

Double lines, regarless of color, do not cross them unless turning.

If only things were that simple. The problem is that the signs are not consistent with the road markings. The road markings indicate you are not to enter or leave the left lane. The sign posted at 123 indicates this is a restriction on the HOV lane, which the left lane is not for an extended period of time. If the people who posted the sign didn't want you to switch lanes during non-HOV times, why would they indicate it was an HOV lane restriction? Was the sign put there for emphasis, or was it intended to create a separate rule for HOV v. non-HOV use?
