non paying roommate

I have a roommate who is renting a room. He has been there 1 month. Its apparent he won't be able to pay rent for the next month. He doesn't get squatters rights after some period of time?

Do you have anything in writing? Is he on the lease?

If not, arrange for a face to face discussion and state clearly what your expectations are regarding his financial obligations and ask if he can meet them on the schedule required to keep all the house's accounts current. If he can't meet them...he's gone.

Why is this so hard?

Make sure he understands that when does not pay his rent he is not able to rent the space. Some people don't understand that.

Virginia § 8.01-236 aka the squatters law says he has to be there 15 years. The landlord has to give 30 days notice to kick him out...

It sounds like he has no job.

Hopefully, you have obtained from him a security deposit and the first month's rent beforehand.

His rent for the second month should be due within the first five days of the month accounting for a grace period.

You should let him know that he needs to make arrangements to move out.

I don't believe you can throw him out until he actually misses the rent payment due date. However now is the time to begin learning about the process to throw him out once he does miss that payment.

I had a tenant name Michelle Barrett who was subletting a room without my landlord's knowledge and I let her slide on the first month's rent. I seriously regret it as she ended up causing a lot of dissension in the house and was just a bitch on wheels. I later found out that she had a bad history with several past landlords. Her girlfriend in a prescription drug stupor almost burned the house down. I didn't need the stress as my girlfriend was breaking up with me and taking her big beautiful artificial breasts with her because of my jealousy of guys hitting on her at the bar where we worked. Took over a year to get that bitch (Michelle Barrett) out, then I moved in a pair of Latvian strippers toute de suite. Fuck that bitch.

Went through this a number of years ago myself. Suggest you talk to him about why he can pay his share of the rent. From there assess whether he will ever be able to pay last month's rent, this month's, and so on.

Give him a set date for paying you, like both last month's and this month's due on the date for this month. And tell him if he can't then he's going to have to move on as he's messing up your finances. That's exactly what I did, guy moved out two weeks later, found I didn't need him after all to help cover the total rent and was stress free after that.

Go to the courthouse and ask about filing an "unlawful detainer". The clerk will walk you thru some of the process.

Tell Deadbeat this is your next move unless he puts some money in your hand with a quickness.

I think the eviction process takes about 2 months in VA.

24-Hour Lock Change Eviction—This is the most commonly used eviction because it is far less costly than a Full Eviction. Possession of the dwelling is granted to the plaintiff within 24 hours after the scheduled eviction date and time. On eviction day, the plaintiff must provide a locksmith to change all of the locks on exterior entrances to the dwelling. The dwelling becomes a storage facility for the defendant's property for the next 24 hours. The plaintiff must grant the defendant reasonable access to remove his or her property during that 24 hour period. The defendant cannot stay in the dwelling overnight. At the end of the 24 hour period, any property left in the dwelling goes into the possession of the plaintiff who must sell or destroy it. If the defendant remains on the property or returns to the property after the 24 hour period expires, the defendant is trespassing.

in virginia there is no such thing as a "self help" eviction. aka, the landlord cannot change the locks, move out one's belongings, etc.

you must go through the eviction procedures linked above.

also, go ahead and issue the 30 day notice at the same time as the 5 day pay or quit. and pay the extra few bucks to have the sheriff deliver it.

Once the first of the month rolls around without a payment, you can give him notice payment is due by the 5th.

When he misses that payment, you can give him the eviction notice.

I would get somebody else to write the warning note. You might also search the WWW for form letters. Lawyer sites will often have them.

Judge Judy practices law in the state of NY. She would have to get a sspecial permit to practice law in the state of VA and she would need to request notice for her film crew to set up shop in a courthouse that administers lawful proceedings.

No, Judge Judy does not practice law in the state of New York. She is retired as a Manhattan Family Court judge. Judge Judy is now a legal private arbitrator on TV, whose workplace is in Culver City California. She commutes from Naples, FL or suburban Connecticut in a private plane. Before you go to her "court," you must withdraw any legal proceedings you may have with your local legal jurisdiction(s), and sign a contract binding you without further legal recourse to her rulings, findings, or legal remedies on your case (unless Sheindlin dismisses the lawsuit without prejudice).

She wouldn't need an real courtroom to practice what she does in Virginia, because she is no longer a real judge, she would just need a room.

No, her workplace is in Hollywood, CA which is about 15-20 minutes away from Culver City. She does, however, sometimes film her show in Queens, NY.

In other New York information, I know for a fact that there is this talking furry animal in the east Village that that lives in a garbage can. Also in the east Village, six friends, two being hot women who will go to bed by the third date, meet up almost everyday at a coffee bar called "Central Perk." You can find them all sitting on the couch in the middle of the place almost any day of the week.

Judge Wapner set up a system for TV judges that I believe is the standard to this day. this is how it goes. There is maximum dollar fund dedicated for each case. Wapner set it at $5,000.00 when he built "The People's Court. If you are awarded $5,000.00,(or whatever the max is today), the other party gets nothing. If the award is lower than the max, there is a formula they use to give the losing party some money. The entire payout per case is never to exceed the maximum payout. They also pay your travel expenses which may, or may not, come out of the dedicated fund.

Disclaimer at the end of shows like that:

Both the plaintiff and the defendant have been paid from a fund for their appearance. The amount, if any, awarded in the case, is deducted from this fund, and the remainder is divided equally between both litigants. The amount of the fund is dependent on the size of the judgment.

Pretty much what I said. Wapner's max payout was $5,000.00 per case, but I am sure if you are awarded $850.00 by Judge Judy, you aint splitting $4,150.00 with the other guy. Maybe he gets $400.00 and you get an additional $400.00. There are formulas for determining what each side gets. If you are awarded the max, though, the other guy gets nothing. I have seen Judge Judy say to the defendant, after awarding $5,000.00 to the plaintiff, "you get nothing for coming here, and I am perfectly fine with that."

Unless either party is a member of the Screen Actors Guild. In that case they must be paid according to the union wage scale, including overtime.

In any event, all expenses are paid for all parties, and of course they get free food and refreshments before, during, and after the filming. Also, there are sometimes residual payments for re-runs, depending on what terms their agents negotiate.

There are plenty of agents that cater to small-time actors. Some people go on Judge Judy for the express purpose of getting on camera -- with the full cooperation of both parties. Sometimes the entire "dispute" is fabricated just for the show. It's just for entertainment purposes, not a news show.

There is a good way to get rid of an unwanted roommate. Just never wear clothes in the house. Even better if you walk around with an erection. Make sure to pass by in hallways and brush against roommate. For really stubborn cases, have an "accident" on the problem roommate's doorknob, possessions, etc.

Just tell him gas, grass or ass, nobody rides for free.

Perhaps he could use an alternative form of payment, such as duty bunk. To play duty bunk, he strips down to his underpants with them on backwards so the pee slot is positioned over the poop-shute. Whatever the case, I sure the issue will be resolved either way. When he realizes someone may go through his backdoor, he'll likely pay up quickly. If not, enjoy yourself. But, remember not to act gay, because being gay is nasty.
