Chantilly Company Faces Maternity Leave Lawsuit

A woman once employed by Chantilly-headquartered Engility Holdings Inc. is suing the company, saying that the company fired her while she was on maternity leave and hired someone to do comparable work.

The former employee claims the company is in violation of the Family and Medical Leave Act, according to a story in the Washington Business Journal.

The former employee, Tamika Edmonds, had worked for the company, located on Centerview Drive, for eight years as a payroll specialist. She filed a complaint with the U.S. District Court for the District of Columbia stating that the company terminated her 12 weeks into her 16-week maternity leave, claiming that the position had been eliminated. However, according to the lawsuit, the company changed the title of her position and hired someone else to perform virtually the same job.

The Washington Business Journal reported that Engility allegedly pointed to changes in the payroll process at the company but Edmonds fired back, pointing out similarities, in her complaint, that the job is much the same.

Edmonds is suing the company for violation of both the federal Family and Medical Leave Act and the D.C. Family and Medical Leave Act, as well as for retaliation under both statutes, WBJ reported.


Edmonds is suing for lost pay, benefits and more.

The company did not respond to the Washington Business Journal, saying it did not discuss matters in litigation.

Dumb move on the company's part. Looks like they wanted to fire her regardless of her maternal status and went though a lot of contortions to do so. This will probably get ugly.

And 16 weeks for maternity leave? That's ridiculous. I got 8 and they tried to get me back earlier. It's a burden on the company and her co-workers to be out for that long.

I expect it will be resolved behind closed doors for an undisclosed amount of money. Otherwise, you can expect a circus with a march of civil rights lawyers leading the charge.

What the color of her skin has to do with any thing. When you are at work you do have something called lunchtime. Calling her a dumb ass is clearly why they are getting sued. You must work with them.

Anybody hear the reports about the medical company CEO that went to China to fire a bunch of employees?

Those Chinese girls locked his ass up. Apparently it's common for american pigs to skip town without paying the workers. These girls told him, "you're going to pay us, motherfucker".

I wish they'd slice up his thieving corporate ass and make chop suey out of him.

Sort of dumb to fire her while she is out. The law does not require you to take her back. We have people go out on medical leave periodically (almost always deadwood) and when they say they are ready to come back, we just say that we no longer have a position for them.

We actually had two staff members try this recently after they were given layoff notices. We just delayed their official layoff until they day that said they were ready to come back.

We have since gotten new business and are hiring again...and not them...and all of this was in consultation with our general counsel. It's not that tough to be compliant with the law.

Why not just be honest and tell them they're screwing up? That's what performance reviews are about right? I did them with my employees and I think they respected me more and did better when I was candid with them. I told them where they were doing well and where they were screwing up. I told them if they didn't improve they would be out of a job. I can only think of a few in the past 20 years that didn't pull their act together.

Do your employees use shovels?

I work for a large tech company...and getting rid of deadwood takes an act of god. You can spend your entire day for months on end trying to mentor some people and get nothing in return. It's like teaching a dog to drive - it's a waste of your time and annoying for the dog.

Not everyone is above average.
