Maryland State Police say a 10-year-old Jasmine Warr of Twinsburg, Ohio was killed in the hit-and-run.

Warr was riding in the backseat of a 1995 Jeep Cherokee when a 2005 silver Range Rover with Virginia tags struck it from behind. She was taken to Shady Grove Hospital, where she was pronounced dead.

Police say the Range Rover was traveling "at a high rate of speed" when it slammed into the back of the Jeep shortly after midnight.

The driver of the Range Rover did not stop and continued driving for about one mile until he got out of the vehicle and fled on foot, police say.

Police say 32-year-old Michael Dean Eaton of Fairfax was driving the Range Rover.

Troopers are asking anyone with information regarding the accident or the whereabouts of Eaton to contact the Maryland State Police Rockville Barrack at 301-424-2101.

Might of been a smart move to flee. Now police have to prove he was driving, he was probably drunk so there will be no evidence of that now.

He most likely will be charged with vehicle manslaughter, fleeing the scene and the family will sue his ass. Most likly get 15 years jail time, with good behavior just do 7. He'll get out when he is 41.

Hell of a way to spend your 30's, in jail.

Either way he is probably going to jail. I contend that by running, he probably just INCREASED his jail time rather than if he stuck around and just took responsibility.

I have no clue. I assume it is done from hair. I heard it from two very reliable sources. I also had a buddy of mine who had to do some ASAP classes and he said ASAP could tell if somebody had a drink with in the last four days.

By looking at the damage to the Jeep it looks like the Jeep pulled into the path of the Range Rover and was barely moving.

So we are all assuming the Range Rover driver is at fault? What if the driver of Jeep was on the shoulder, got distracted by a ten year old and just pull right into traffic going 70 mph?

If the father is the driver of the Jeep and he is at fault, should he do jail time?

Or are we going to let him off scott-free, because he wasn't drinking and had close ties to the victim? Maybe it was planned?

It isn't unheard of that someone can pull in front of an at-speed vehicle to have that happen... the drunk/stoned girl did that last summer at the mixing bowl, hitting brakes and swerving into the path of an at-speed rig.

But I agree that one does not drive farther and flee the police if it is an innocent mistake.

I knew him in High School. He was a clean cut kid. popular, everyone liked him. He was also a sensative guy at times. Wow. What a shock!! Never expected this from him. really out ogf character. I know he must feel horrible about this. At fault or not. What ever reason he was scared - that is why people run. You think you know people or grow up with them and then you see how some turn out. It is scarry. Scarry to know or someone that could walk away from a scene like that. I feel for the family and the little girl who has passed on. Their pain must be unbearable right now. I would like to know the full story as to what happened. the way it looks though, the Cherokee must have pulled in front of the Range roover.. to be hit like that from the back.... on a highway.??? Don't forget we are all human. I am sure no-one wanted this to happen. We are not hear to judge, even when life is as screwed up as it is. We all have made mistakes. not intentionally. My heart goes out to her family.

The charges are just beginning to rack up. Remember they have to perform an investigation, and if witness saw him drinking all they need to do is run his credit card and find out were it was last used. Regardless, there are witnesses that saw him drinking, and the bar tender serving him will be extremely cooperative with the police. Trust me the bar tender will let the police know how belligerent he was before leaving the bar. He is looking at vehicular homicide if found to be drinking and driving. As far as all the other posts the 1st one was probably the most intelligent, "looks like he's upping the game." The speculation around him having money, because he drives a $50k car is nonsense. Remember, there's lots of spoiled brats out there and a lot more that graduated from the same high school. He's most likely looking at 25 years to life, although Maryland does have the death penalty they are way to liberal, and would never sentence him to death. I think sitting in Jail for a while will do society a big favor. Finally, lets see what they set bail at, do we have any takers on the exact amount?

Yeah, I'm sure the police would never have caught on to that lie. Do you really think that it doesn't look the least bit suspicious for someone to call in their vehicle "stolen" AFTER another crime has occurred? The police half way expect for people to pull that shit anyway.

The only thing that move would have accomplished would be to add "filing a false police report" to his already growing list of crimes.

I guess as long as people think that calling in their vehicle as "stolen" throws the police off their tracks then that makes the job of the investigators that much easier.

And this thread is truly disturbing. Instead of expressing outrage that an innocent 10 year old child is dead, we have several people on here focusing on ways of possibly "beating" the charges.

I am not focused on "beating" the charge nor am I defending the guy. It's just a "what if" situation. Well, what if hypothetically the car was really stolen and the guy hit and killed someone, how could they prove either scenario? If the guy is brought in to questionening and doesnt confess then they dont have a case, unless there were witnesses and they ran his credit card, even then all he would have to say is that his wallet was in the car and someone that stole the truck looked a lot like him. He got what he deserved and believe me I am very outraged by this but in reality if he was a coward and didnt turn himself in he could have walked away from this whole thing, collect his insurance money and go on.

Really??? Do you know that if the bartender over served him he could also be at fault and the bar could be sued or lose its alcohol license. I'm sure the last thing the bartender is going to say is he looked really bombed when I served him.

As for his tab, just because there are drinks on his tab doesn't mean he drank them, maybe he bought drinks for other people on his tab? I routinely buy girls and friends drinks on my tab.

Witnesses at the bar? First off they would have to be sober witnesses, second are they trained are certified in spotting drunk people? That's all hearsay not admissible in court.

He wasn't tested so he can not be charged with DWI.

Michael Eaton was arraigned today and bond was set at $250,000. He was not held, ordered not to drive (duhh, didn't he have a suspended license?), keep a curfew, and go through drug counseling. Was only charged with hit and run. Not charged with the accident or the death of the child. It's all pending toxicology reports.

I might be wrong, but turning yourself in 14 hours later would assure that all evidence of alcohol would be gone. Its scary to think that we will probably be sharing the roads with him again before long.

Wow. This is such a messed up situation. I really feel so sad for the family that lost their little girl. However, just because someone was a dick to you in High school. Doesn't mean they are branded for life. I hung out with him, he wasn't all that bad, ya he could be a dick. But can't we all at times? We all make mistakes in this world even to others. Doesn't make it right, but shit happens. We don't know the details of the case. Come on the press makes his record look bad.. 2 speeding tickets. WOW what a crimanal. Oh poss. of the Maryjane 10 YEARS ago. (right out of Highschool) YEP Branded for life. lets not forget the EXPIRED REGISTRATION. Come on people. Innocent until proven guilty. This was a Horrible accident - one that all parties will NEver forget and Mike will live with this the rest of his life. He did turn himself in, which is more I can say for many who run any accident. Hell many that result in an accidental death of any kind (that ran). In High school he partied with the rest rest of us.. Not many from LB didn't. Even those on this post. He was scared, he ran. Toxicology reports are very accurate these days and can find alcohol in a system for days, I've also heard months. I'm sure they will also be interested to see if there are other drugs in the test.

Interesting they didn't charge him with the accident, they must believe he was not at fault. That goes towards the theory that the car pulled out in front of him from the shoulder.

Oh puhleez Gravis....he may not be a hardcore criminal, but does it get any worse than killing someone? Yep, such a great citizen...turned himself in after 14 hours so the alcohol is out of his bloodstream. I certainly commend him for that!

What lesson was learned? The dead child's family learned that you can be killed by innocently driving down the road. Michael Eaton learned if you run like a coward and hide for 14 hours, you can avoid being charged with DUI vehicular manslaughter?

Gravis, it sounds as if you are making assumptions yourself. Could you please provide a link from a credible news source that suggests that the Warrs family pulled into the path of Eaton on I-270? The only thing I have seen reported thus far is that Eaton was traveling at a high rate of speed and collided with the rear of the Warrs vehicle.

Based upon my own experience I would suggest that IF Eaton was intoxicated and he was traveling at a high rate of speed then its also quite possible that the Warrs family was doing nothing other than maintaining their lane and was struck by Eaton from behind as he was rapidly accelerating. I was almost struck from behind on the Beltway at night a few months ago doing nothing other than driving straight in the right center lane (4 lanes). The other driver came upon me so fast and came within inches of rear-ending me only to careen into the left center lane to pass at the extreme last second and almost collide with another car that was just in front of me in that lane. I thought I was toast. There was other traffic in my proximity on the road and there was literally nothing I could have done to avoid his vehicle due to his speed if he did in fact end up colliding with me. I then observed him do the exact same thing to another vehicle further up the road. He was driving so fast that I couldn't even get his plate number to call the police. My suspicions were that he was intoxicated.

I think I've been posting here too long; I keep thinking I've read this thread before because it is similar to so many we've had in the past.

In any case, I'd like to join the speculation. My guess is that Eaton was not at fault, but freaked out because he was driving on a suspended license (and possibly intoxicated). He fled, not knowing that a child was killed in the accident. And after realizing that this was not something he could continue to run from, he turned himself in. Of course his record makes it very difficult to be objective.

IMO,I am sure that he turned himself in because he KNEW that he is going to get caught, not because he felt the guilt of killing another human being. Also he turned himself in 14 hours later because he knew it was going to be a one less charge to deal with. He has done a horrible thing and god will judge him but there is nothing he can do to change the past and I am sure living out the rest of his years in prison was not in his plans so now he will do whatever he can to get away, 5-10 years on 1/2 release will be the sentence.In America Money=Freedom

The only thing Eaton has been charged with is fleeing the scene of an accident. He may not be at fault in the accident. The driver of the Jeep may be at fault.

Perhaps the driver of the Jeep has done a horrible thing by ruining Eeaton's life.

I was on the scene of the accident. It is a sight that I am having issues dealing with today. I will never, ever, as long as I live, forget the sight of Jazmine and Cortavia in the backseat of that Jeep, nor will I stop hearing Angela's sobs as she cried on my shoulder.

Regardless of who is at fault, the fact is that Eaton was, according to numerous witnesses, driving in excess of 90 to 100 miles per hour--even if the Warr vehicle did pull out in front of him (which has not been established), had he been traveling the speed limit, or somewhere near it, I can't help but think that the damage done would have been less, and Jazimine would be here today. Only an assumption, no one will ever know.

Also, I've been on the interstate before and swear a car came up on me out of nowhere, driving so fast I didn't even see it coming. If the Warr vehicle pulled out, again, the speed in this situation is a key factor in the damage that resulted in loss of life. It is possible that they didn't see him coming. Of course, this, again, is a detail that we can all only make assumptions on.

I do beleive Eaton deserves a fair trial, although, after witnessing what I did (I will not go into detail, it haunts me enough), I am ashamed to say I hope he gets what many think is coming to him. Before you slaughter me for that comment, please understand that I know my judgement is possibly wrong, I recognize and take responsiblity for this, and of course it is skewed due to the fact that I was there and saw a horrific scene---when he wasn't. I, along with many other drivers by, were trying to help, before the emergency vehicles even arrived, and he had fled. I do understand that he was scared, and this will haunt him until the end of his days. And though it may be wrong, I can't help but feel anger toward this man. It's just such a tragedy.....

Ironically, we came home from our trip to DC and the story of the accident was in OUR local papers and on OUR news channels--turns out we live only 29 miles away from the Warr family here in Ohio. Small world....

I guess I'll close by saying, discussion of a situation like this is expected, even necessary--but personal attacks on each other are without benefit. None of us know the exact circumstances--we very well may never. The hard core truth is, both families will suffer through this indefinitely--the Warrs and the Eatons. It is a horrible tragedy, regardless of who is at fault. An adorable little girl is dead, a family is changed, and a man's life is forever altered regardless of the court's findings. Let's just pray that everyone involved can find the strength to pull through.

Yes it is a tragedy that a little girl is dead. I find it hard to believe that the police and all these witnesses don't know how the accident happened.

I'm speculating that the Jeep was at fault but the police and media don't want to say that because it doesn't make a good story in media and police can't use it as an example.

pgens--after re-reading all of the posts--you are right. I HAVE seen threads with much stronger personal attacks. I suppose I was focusing on only one comment that stated someone made a "completely rediculous statement." None here are rediculous (though I didn't really agree with the staement either), and it bothered me a bit that someone's opinion was deemed rediculous. So I do see the difference between heated discussion and personal attacks--thanks for pointing that out, pgens. Accept my apology!

Jester--First I never "rejected" people who do personal attacks or have strong opinions. Second my statement was not a direct personal attack on Eaton, merely an opinion of what I think justice should be (I'm gonna get it for that one!). If you recall, I did say was possibly wrong of me and that I was ashamed to admit. I am a bit skewed because of what I saw, but I will not attack anyone's opinion on this thread (which is where I was going with that comment, nothing to do with the Warrs or Eaton, merely those in this discussion)--everyone has made extremely good points, and really gotten me thinking about other angles in this situation. I hope you can see the difference. And you may very well be right about the Warr vehicle being at fault--who knows? I arrived after Eaton had left, and I have no idea if the other people there witnessed the accident, or if they stopped after the fact like I did. As for the media, you have a very good point--if it lessens the story, quite often it is left out. Sad, but true. Thanks, Jester.

Looks like Eatons trial have been put off until March 17, 2009 as of today. It had been scheduled for this Thursday, Dec 18, 2008.

He could get the MAXIMUM of 10 years. I'm sure he has an expensive attorney who will sing some sort of sad song for him. Im betting he gets time served with probation. It makes me sick, but that's the way things are these days. No one has to be accountable for their actions.

He got 8 years, eligible for parole in 4. Pretty easy for killing someone. I hope the family sues for the cost of the funeral, expenses for the burial, and family medical expenses.
