wanted: the FU wreckless driving ticket review

my moron friend who does not live in the area was ticketed by the state police in the county of botetourt for going 88 in a 65.

her court date is coming up. if she cant make it to the court date, what is she looking forward to as far as fines, points, etc?

maybe she can. until they start handing out spelling tickets, im not going to lose much sleep. great observational skills though. i dont know what would kind of chaos would ensue had you have not taken valuable time out of your day to point out my error.

She does have to appear for court. I'm sure she was advised of that by the officer. Reckless is not a pre payable offense. In VA reckless driving is a criminal offense and not just a traffic offense. It is a class one misdemeanor which means it the maximum punishment is 12 months incarceration and/or a $2,500 fine and/or 6 months license suspension.

And from what i have heard about Botetourt County, they are VERY strict. They catch all the college kids from Tech and Radford who are speeding on 81 and throw the book at them.

Going 88 mph is fast. She almost hit 90 which means automatic jail time. I'm sure she will get her license suspended for 6 months.

First, Botetourt County DOES suck when it comes to this. I got a ticket from going 73 in a 65 on 81, fortunately I was able to prepay and have it done with.

Second, if your friend does not show in court they will issue a bench warrant for her arrest so if she were to get pulled over or stoped at a check point in the state in the future she would be arrested and processed. This happened to me before and it isn't the worst thing, they usually dismiss the bench warrant charge once they get you in court as long as you have a reasonably valid reason for missing the court date.

Bottom line is that your friend needs to come back. It may be in her best interest to hire a local attorney for a few hundred bucks who knows how things work there and can talk down the charge with the ADA and/or Judge. It is better to spend the couple hundred and save $2K and still be able to drive then to show up empty handed and leave it to the courts.

Yep, there is nothing else for the VSP or the sheriff to do down there. So they sit on the side of 81 near Buchanan (or Route 11) and nail truckers, pass through drivers, and college kids (W&L, VMI, Hollins, Tech, JMU, etc., etc.). The bridge area near the James River is a prime hot spot.
