I know, it's somewhat confusing and "either/or" in nature. If we had declared the terrorists "POW's", then we could hold them indefinitely until the cessation of all hostilities. I'm assuming however that the waterboarding would become a real issue at that point, and on top of that, somewhere along the line Americans want to execute someone who we can officially declare responsible for 9/11.
I hope the Justice System does in fact work, but if we are to use past wars as examples of legal precedence, then anyone involved in warfare with us should be tried in a Military Tribunal. The Civilian Court is only being used so that Attorney General Holder, and thus POTUS Obama and his Administration, can declare any subsequent conviction(s) to be a triumph of their doing. I don't believe that playing political games with a terrorist is right, nor do I believe that the resulting attempt to re-precedence past matters is a good idea.
I also would like to see the Sheikh face execution by firing squad, with a hood over his head (Which is standard procedure anyhow). Any sort of "Lethal Injection" should be completely off the table, as it seems far too kind for such an evil individual.
