How do you mount an insanity defense for a crime that was committed nearly 10 years ago? I can see how, maybe, that would be relevant in the UVA case, but wouldn't state of mind in 2005 be difficult, if not impossible, to prove? I am not an attorney (obviously), but you would have to believe that there will be dozens of character witnesses called by the prosecution who will describe Matthews as a stand-up guy, gentle giant, whatever over the past decade. Is there a doctor who will testify that all of this was a facade?
