A Rhode Island man may be the first person charged under a new upskirting law in Massachusetts, where police said he tried to chew the evidence.
Sheldon Fulbeck, 37, of Lincoln, is accused of snapping pictures with his cell phone under a dressing room partition at a Target store in North Attleborough while a woman was trying on bathing suits.
According to the Sun Chronicle, police said the woman spotted the phone and confronted Fulbeck before yelling to her boyfriend, who was waiting outside the dressing room.
Police told the newspaper the boyfriend tackled the suspect and held him down on the floor with the help of another man until officers arrived.
During the struggle, Fulbeck managed to get his cell phone opened and tried to put the memory card in his mouth and chew on it.
Fulbeck pleaded not guilty to unlawfully recording a nude or partially-nude person, disorderly conduct and disturbing the peace. He was released on personal recognizance.
He's due back in court May 27.
If convicted, Fulbeck faces a maximum of 2 1/2 years in prison and a $5,000 fine.
