If a driver is weaving in their lane (regardless of sobriety) but the tires of their car have not touched either lane marker can the police legally pull you over?

yes they can. weaving = reckless driving and they have to be safe rather than sorry and check up on you.

Yes any sort of weaving you can be pulled over for and a sobriety test will follow 99 percent of the time

No problem. I've actually been pulled over for this. I was trying to hook my iPhone up to play music. This bitch cop pulled me over and tried to give me a reckless ticket. I went to court and talked it down to a failure to maintain proper control.
