Flyers on Mailboxes

So, I have this pizza flyer that was placed between my mailbox and its red flag. I call the pizza place and ask for a manager. I explain to the manager that I got his flyer, but it was placed on my mailbox, that is illegal and he needs to stop the person in my neighborhood from putting out more flyers. This dude says he checked with the Post Office, and it is only illegal if they put the flyer in the mailbox. On the mailbox is legal.

I told him he was wrong. He argued some more. I explained that a few years back I attended and participated in six days of congreessional hearings on Mailbox restrictions. I knew what the laws actually were, He then said people get the law wrong all the time, and he could place his menue between the red flag and mailbox; "perfectly legal," he argued. I asked him not to do it again, and to next time simply mail his menue to avoid any issues. He said the flyer distribution was legal, and he hung up.

Lesson, if you don't know what you are talking about, shut up.

I reported him to the local Postmaster, and he will get a warning. If he does it again, he will have to pay full postage for everything he places on a mailbox. That is the law.

It's only illegal to place flyers inside the mailbox, and that's true. I've talked to the postal officials about it before. Besides, what is your hang-up about people distributing flyers? We use them all the time here in Reston to bring the attention of neighborhood issues to people.

I'm fairly certain the original poster is correct - it is ilegal to place in OR on a mailbox - awhile back we had real problems with newspaper delivery near us and I looked into what was and was not legal; for some reason I'm pretty sure ON a mailbox is illegal as well...one moment while I search USPS.gov...ah, here we go:

Illegal or not, I'd rather have some dumb flyer on or in my mailbox than some solicitor at my door trying to get me to install a security system, gutters, magazines, or pest control. God I fucking hate that shit.

A few years back, I was advertising for my business. I had not checked first, which I now of course know was dumb, but was out putting fliers on mailboxes. I didn't want to place them on people's cars and not having thought about it first as I should have, I didn't see any harm with where I was placing them. Well, I found out real fast. Going along merrily down a street, I was stopped by a postman who in no uncertain terms, very loudly let me know that what I was doing was illegal. "You are not allowed to place anything in or on someone's mailbox!"; and went on reciting the law to me. I felt like an idiot. Got back home and called the post office and was told that the postman was correct, that you are only allowed to place fliers on a person's door knob. Not inside of a storm door, not slipped inside the crack of a door -- only on a person's door knob and never in or on a mailbox. That halted any flier distribution for me.

First of all, I don't want my mailbox damaged by some pizza worker bending the flag, or getting torn paper lodged in the flag's hinge.

Under the circumstances, because of offense was done to avoid paying postage, The Postmaster is required to contact the offending company with a warning not to do it again. The Postmaster said he would contact a mail carrier in the area to pick up an offending piece, and he asked me what street I lived on.

The USPS has a template letter they use with the law clearly spelled out, and an estimate of the postage due if the offence is done again. They charge First Class postage rates for each piece so the estimate of postage is pretty darn high.

What bothered me is the manager argueing about something he knew nothing about. He was right, and I was wrong, and he knew the law better than I did. Forget that I had 10 years working with the Post Office on defining the laws for alternate delivery rules for everyone from pizza coupons to UPS, couriers, Fedex, and newspaper carriers. He even went so far as to lie, telling me he had the Post Office's permission to place items on a mailbox. What a value for a manager; make crap up as you go along. I will never order from that company again because of dishonesty at the management level.

I didn't report him to the postmaster until he told me he wasn't going to contact the distributor, who was still in my neighborhood, and ask her to stop putting the flyer on the mailboxes.

As displayed here, a simple Google search of USPS.gov would provide the correct answer.

I worked with the USPS on private carrier legal issues, not for the USPS.

I will bet the Postmaster did do something about it. My HOA was hanging announcements to the community mailboxes and I alerted the Postmaster who quickly took care of the situation. And it is not only postage due, it is up to a $300 fine per occurrence.

The USPS has a 100% legal monopoly on the mailbox. You want to use the mailbox, you must abide by their rules.

And another instance of WTL getting it all wrong.

Just saw this post - wanted to add that our neighborhood HOA did provide No Soliciting signs at both entrances to our neighborhood.

You know how much that helped cut down on people/idiots leaving their junk in our mailboxes, wedged in between the flag, on our doorknobs and thrown in our driveways with a baggie full of rocks attached to it??

NOT AT ALL!
