I was falsely accused of theft at work... can I sue?

I was falsely accused of theft of merchandise from work on Friday. However I proved with a receipt and video surveillance that I in fact paid for the item and the associate is a lying little bitch. Can I sue and what type of lawyer would I need? I also recorded the entire conversation with management on my iphone. i also let them know that I recorded it so that it would be admissible in court if that came about and no wire act shit would come in to play... i'm not a lawyer so i don't know if that was needed but I erred on the side of caution i suppose. Any suggestions?

on top of that...also the lying bitch was standing right there when i was checking out so it's obvious that she was trying to harass me.

You may have a defamation claim.

You should find a lawyer who handles such cases, and who will give you a free initial consult. Meet with him or her as soon as possible to go over the facts and see if you have a claim.

My suggestion is to not clog our already-overburdened justice system with a pointless lawsuit.

For defamation of character, slander, etc., you'd need to prove that you've experienced substantial social and financial hardships as a direct result of the store asking for proof of purchase in a suspected theft.

For harrasment, you'd need to prove that the way they went about handling the suspected theft was not in accordance to their company policies, and you were treated unfairly because of who you are, specifically (in regards to race, gender, religion, etc.)

If you're going for emotional duress, grow up. Unless they strip-searched you and made you do jumping jacks to check for stolen merchandise being smuggled in your ass or vagina, all you're going to do is waste everyone's time.

Yes, you can sue, but the odds of you getting anything out of it are a billion to one. You imply that you work at the store where this incident happened, so all you're realistically going to accomplish is a hostile work environment and a bad reference. You'll either quit or they'll find an excuse to fire you, and future employers who call them will hear, "Yeah, this person tried to sue us after we thought they stole something from the store." Not good.

Think about the people who get arrested, put on trial, and are found not guilty. If everyone who was innocent sued the state for being wrongfully accused, states would quickly go bankrupt. You weren't even arrested.

Have them move you to a different position or shift to avoid the "lying little bitch" to prevent this situation from happening again. If they refuse your request ......sue

I was accused of stealing a nekclace on a dead body at work but they do not tell me i stole but i report 4 of us was iinside e the room and now we looking the necklace my boss call the police and i have to go to an ingerrogation and i had to take a lie detetector test

You might have a suit against someone who falsely accused you, the associate, but since you have no damages, there is really nothing to recover, and since she is an associate, she probably doesn't have two nickels to rub together, so you are shit out of luck.

Your employer investigated an alleged wrongdoing that was reported to them by an employee/associate and determined that you did nothing wrong. That is their obligation and fiscal responsibility. They investigated, followed the process, and rightfully concluded that you did nothing wrong. No harm. No foul.

They probably do have an obligation to take action against the employee/associate who made the false accusation. That could include firing them, counseling, a letter of reprimand, more training, etc. Depends on company policy, management's judgement, and maybe what you ask them to do based on what happened. You could say she is a disruption in the workplace because she is a liar and you don't feel comfortable working around such an untrustworthy person.

You probably won't ever see a dime from the associate or your employer and really don't deserve one.

Besides - no lawyer with a brain would take such a loser case on a contingency.

im a truck driver and I was sent a few states away to del a load I told my employer that I had a court date the following Monday he assured me that I would be back in time when I arrived for the delivery the load was rejected because it did not have a del apt when I contacted my employer he didn't have much to say except that I was going to need a new apt I reminded him that I had a court date and that it was going to interfere with the apt del I secured the tuck and load and got a ride back to my home town so that I can appear in court I went to my employers home before the court and picked up my payroll II spoke to my employer and reassured him that after court I would return to the truck and make the delivery after court I went to the bank to cash my payroll and was told that my employer put a stop payment on my payroll I contacted my employer and was told that the truck and trailer and load had been reported stolen by him because he didn't know where the truck was located I reassured him that the truck was secured and that I was on my way back to pick up the truck and deliver the load I was told to explain it to the authorities I was put to great turmoil almost to the point of having a nervous breakdown I finally got everything cleared up and I made the delivery and picked up the reload and returned the truck to the now my former employer can I file a lawsuit
