The Commonwealth conceded that they couldn't prove that I MALICIOUSLY disseminated images or that the images were posted with the intent to intimidate, coerce, or harass.

The revenge porn statute is very vague in its language and relies too much on this abstract concept of "posting images with malice."


BTW, Circuit Court rulings set precedence, so this case will affect all future cases involving this statute.

I have no beef with eesh, but why other than malice would you post humilating nude pictures of someone else, especially someone engaging in sex? If the revenge porn law depends upon proving malice, and malice can't be proven, then there effectively is no revenge porn law. That's really disturbing. I assume this will adversely affect women much more than men.

Posting court transcripts that I paid a court reporter for isn't doxing, it's public information. Anybody could have sat in that courtroom, taken notes, and broadcast it to the world.

The spat between Megan and eesh contains Internet attacks by both sides. Eesh hasn't "done" anything to the "girl" (Megan is approaching middle-aged woman status). He has not laid a finger on her and has not damaged any of her property. Megan is a vicious person who attacks people physically as well as on-line. She has pending assault charges for attacking her mother-in-law who was proving her a place to live, and we have all seen the racist phone-throwing video. Megan has herself sent nude photos of other girls to their friends and families out of malice. Megan was still creating attack threads on eesh as recently as last month.

Transcripts of open court trials are a matter of public record. Megan herself posted the photos and was hoping to use them and the video she leaked to assist her struggling career as a public "celebrity", along the lines of the Teen Moms, Kardashians, Paris Hilton, etc. who have all used leaked sex tapes photos to their advantage. With a long criminal record, no degree, no job skills/experience, she may be onto something, but with her obesity and fading looks she needs to act fast. Megan has admitted she is seeking to get the case on the Judge Judy Show in an effort to gain publicity. Based on the amount of attention this soap opera gets here, a national audience is not out of the question.

Megan was goaded and coerced into filing the criminal charges in this case by William Moreno. The messages that Moreno sent to her encouraging her to file charges have been posted here. She was used by William Moreno as a pawn to further his own vendetta against eesh. It was all a publicity stunt. That was obvious from the fact that the entire Moreno clan, their attorneys, Monique, and a freelance newspaper writer all traveled over 100 miles for Megan's case last summer. None of them were parties to the case, and none has any love for Megan.

Megan used eesh and the legal system, and Megan was used by Moreno. Eesh was vindicated, Megan got publicity she can parlay to further her career, and the Moreno clan got a nice family excursion to Richmond.

Coincidentally, there were a good handful of people charged with posting revenge porn from the Richmond/Henrico county area this year; two very recently this month. (WTF, is that some kind of hobby down there?)
Since eesh was found not guilty and his case set precedent, there will be plenty of legal eagles doing research on same. If any parts of, or full transcript of the court proceedings are posted on another site, or published in trade publications, or displayed in the media, can Toohey have someone else arrested for harassment?

There really wasn't anything earth-shattering about the verdict. The case never should have gotten past General District Court.

Of course the case is public record. Arresting eesh or other people is not Megan Toohey 's end game. She only allowed William Moreno to talk her into going to court because she saw it as a means to her end. Megan Toohey wants to become a famous celebrity, the sort of celebrity who is famous for nothing other than being a celebrity, or having some remote tenuous connection to another celebrity. That is her ultimate goal. She's already been featured on some TV show because she went to high school with a man-killing prostitute. She loved that experience and wants more. In the present day, courts and the legal system have become an extension of the entertainment industry.

You brought up an excellent point. When we were in General District court, Megan listed off all the police agencies that she has reported to over this site and her pictures. She testified that she went to Fairfax police, Prince William police, Louisa Sheriff's department, Alexandria police, Loudoun Sheriff's department....and finally Henrico police.

Henrico police were the only ones that took out warrants from her allegations. Every other police agency told her there was no probable cause for an arrest.

Henrico has been in the news this past year for arrested dozens of people for computer harassment and revenge porn. I don't know if it is the Commonwealth's Attorney for Henrico that is eager to take these cases to trial, or it is the police chief for HCPD that is putting pressure on officers to arrest people for computer crimes.

The point is, Henrico is far more eager than Fairfax or Prince William or Loudoun to bring charges on people for computer related matters.

Verdicts in Virginia trial courts have no precedential value. There are even trial judges who will tell you "Don't quote me to me." There are thirty different circuit courts in Virginia, each of which has between 1 and 15 different judges. Establishing uniform standards when you have that many judges, and when many of those judges are not offering published opinions, is worthless. At best a trial judge's ruling in one case is an indication of how that judge is likely to rule on a similar case in the future.

It is not unusual for circuit court outcomes to differ from district court outcomes. Sometimes it is simply because the prosecutor in the circuit court isn't motivated because it's a small matter. Among judges, General District Court judges are most often concerned solely with the question of whether the Defendant did the act alleged. They are less concerned with legal issues such as whether the Defendant had a right to commit that act, or whether the act was justified. Circuit Court judges pay more attention to these issues.

So far this year, Megan has:


Pissed off a Prince William detective so bad that he arrested her for filing a false police report.


Sought a protective order on me that was eventually dismissed.


Initiated two criminal charges that resulted in acquittals.


Initiated a criminal charge on her mother in law (results will be in on Tuesday.)


Went to the magistrate on me with allegations of stalking. Magistrate told her there was no probable cause for an arrest.


Went to the magistrate on me for telephone harassment knowing that I didn't contact her and knowing that I don't even have a phone number for her. Magistrate told her there was no probable cause for an arrest.


Now she is threatening to go once again to the magistrate for posting public documents.



She doesn't know how to stop.

I would almost think you were trolling about Hammy trying to launch a tv career, but she did contact Judge Judy.
If Hammy or anyone else believes for a moment that she has some chance in the entertainment business, they are sadly mistaken to the point of hilarity.

She was also on 60 minutes or some such TV crime show. They interviewed her because she went to high school with a man-killing prostitute. It is on Youtube, and had a thread on here.

That is seriously Megan's goal in life. To be some kind of fake "celebrity". She's also willing to do the hair and makeup for them as a way to work her way in.

I printed these off and they were used as evidence at trial.


When first asked about her contact with Judge Judy, she claimed she wanted to be on the show about her divorce....then my lawyer entered into evidence the post she made about contacting Judge Judy on me. She testified that Judge Judy heard about the case and contacted her first and invited her onto the show...

There are numerous laws in Virginia that include "intent", and there is already plenty of case law that supports the verdict you got. This is what I have been saying all along.

Nope. Wrong again. The Commonwealth's Attorney even stated at trial that this revenge porn statute is a new statute and that there is no case law.



Don't take my word for it, I'll post the transcripts when I get them.

I was referring to the "intent" component, used in other statutes unrelated to revenge porn. There is precedent for the need to prove intent when it is part of the law.

Excuse me? Megan had me subpeaoned against my will after I told her numerous times I didn't want to be a witness and all it got me was more shit. So fuck everyone lol, everyone's going to get their karma, I don't care anymore about any of this shit.
