Discussion- Interestingly enough, Mr. Wiedemann's website made Ashley Madison data searchable and available to the general public. It is my belief that Mr. Cary Wiedemann will have a hard time defending himself using Section 230 of the Communication Decency Act. Per the referenced article-

"But a new lawsuit filed against Amazon Web Services, GoDaddy and sites that made the Ashley Madison information searchable has a unique legal strategy: it wants to hold the defendants to blame for aiding and abetting hackers in the spread of stolen data. The three litigious users may have been outed by the leak but they’re staying anonymous in court, filing the $3 million suit last week in Arizona District Court as “John Does.” Their suit alleges that websites such as ashleymadisoninvestigations.com and ashleymadisonpowersearch.com took stolen information and made it easily available for public perusal, and that Amazon Web Services and GoDaddy became complicit by failing to comply with requests to remove the stolen data from their servers."

While I agree that Amazon and Godaddy may get to claim CDA 230 and may be successful, there is precedence that they may not be immune- reference: Texas and Godaddy/Revenge Porn/Texxxan.com. Secondly and probably more important is that Cary Wiedemann's site is not at the level of Amazon and Godaddy, that role may be held by his ISP InfoRelay Systems of Herndon or the search engines themselves. As the legal owner and moderator of the website Fairfaxunderground, Mr. Wiedemann fits the following portion of the referenced article-

"But sites such as ashleymadisoninvestigations.com that made hard-to-access information easily searchable and then profited off of it might be easier to pin as bad actors who worked in cahoots with hackers to illegally distribute stolen information. Given the media frenzy surrounding the hack, it would be hard for the sites operators to claim they didn’t know the information was stolen."

I believe that Mr. Wiedemann's website falls into the category of someone who is promulgating stolen data knowing that said data is stolen. Cary states on his website that the data might be from stolen credit card information and related to the Ashley Madison hack.

Compliance with a Canadian Court Order/Restraint- I believe Mr. Wiedemann is not in full compliance with a court order sent to him by his ISP. While he has placed the court order on the front page of several of the posted links to Ashley Madison data, the data is still searchable by Google.com and other search engines- this was verified last night by using Google.com's removal tool. Secondly, Mr. Wiedemann appears to still be hosting the data on other pages within his website, with a personal disclaimer written by Mr. Wiedemann himself AND he has not posted the required Court Order/Restraint.

Removal of the data- Please note that while Mr. Wiedemann claims that he is willing to remove personal data if asked, several are reporting through Reddit.com and other sources that he is not responding to emails nor removing the data. Cary's non-action may be construed very negatively in a court of law, as there is no good reason not to comply with one's own terms and given the known issues with the data being public- attempts to blackmail, extortion, suicides/deaths and other potentially catastrophic events, one may think Mr. Wiedemann has no intention of removing what is stolen data- willful negligence.

Other Paths of Legal Recourse-

1) Possession of stolen data is a crime, especially when one knows it's stolen,,, the data didn't come from nowhere. Per the referenced article- “While these persons and entities may labor under the belief that their actions are entrepreneurial rather than criminal,” the suit reads, “the fact remains that they are in willful possession of stolen property.” Aiding and abetting. Willful possession (Cary owns the website in question) is easy to prove here and because the possession of such data can be deemed illegal, this could also lead to exempting Cary Wiedemann from protections under CDA 230.

2) Promulgating what appears to be billing names, addresses etc. (Mr. Wiedemann claims that the data might be from stolen credit card information) poses a security risk as a perpetrator now has one piece to a security puzzle and now all they have to do is find-out a customer's SSN (can be sourced by nefarious players) and some other minor details to make account modifications via the phone etc. It is important to note that Cary allowed email addressed to be posted as well, which are commonly used to login to financial accounts etc. This points to his intentional negligence from a civil and potentially criminal aspect if he is taken to court.

3) Acts/Outcome Linked to Data Posted on Cary's Website- If even the slightest negative outcome is reported in Washington D.C. and Virginia, e.g. death, dismemberment, harassment etc., and the source is known to be because of illegal data place in full recognition of Cary Wiedemann and there is potentially evidence present on the (his) website linking to a crime committed, Cary may not be immune from at least civil suit. While this is a longer shot, there is precedence and proof that the data in question is harmful- e.g. suicides, other deaths, extortion etc. Cary himself has acknowledged in his own writings on the site that bad things have happened and are happening to people linked to the data breach.

Cary Wiedemann would be best suited to take-down the information for a multitude or reasons. It is important for you to note- all data below publicly available through legitimate legal sources about Cary, his employer, the ISP for his website and legal sources investigating this case or that can be available to you. Cary's ISP is aware of the data on Cary's site and they must comply with the Canadian Restraint. You can help hold Cary accountable, though legal and moral means, by emphasizing what has been sustained on Cary's website while he has full capability to remove the data completely. Given his current employer and the long list of notables, I am not sure they understand the impact/relation of their name being used on Linkdin under Cary's personal profile.

Let's remember that because someone used AM does not mean they cheated. Some were curious, some were lost,,, some may have cheated,,,, 35M+ reasons. The health and welfare of a person is also the health and welfare of their family--- no family should have to be exposed to local actors knowingly allowing illegally hacked data to be on a personally owned website. The inaction in this case to remove the data knowing it is possibly illegal is in my mind criminal and shows no sense of concern for the general public-- something that in court, if found guilty could lead to a longer sentence in the sentencing phase.

Leave Cary alone. Go after Mrs. Snowden. I'm telling ya, he's quaking in his boots now. Karma's a bitch and she wants Mrs. Snowden's dick in a vice. Unlike the pros who hacked AM, I'd bet that Mrs. Snowden didn't cover his tracks well enough to avoid getting caught.
