The liability would result if there was an accident while someone else was driving the car. Insurance companies do not like getting scammed and have gotten pretty good at detecting shadiness. The insurance might pay out for damages, but would then come after Josh and demand repayment from him.

I think she got her license reinstated since she paid off all her fines and court fees, but she can't get insured without astronomical premiums because of her DUI conviction and the fact that her license was suspended for 12+ years.

I call bullshit on the Fusion being leased because lessors require proof of insurance before the car is driven off the car lot and also the fact that in order to be approved for a car lease, your credit history has to be far better than someone who is actually financing a car. I'm in the insurance business and I only know you kooks through a mutual former friend. It's not basement legal advice it is the rules set by your insurance company and the Commonwealth of Virginia.

Whoever is driving the car needs to be named on the policy and they need to have a valid drivers license. Unpaid chauffeurs need to be on the policy, even if you are "always in the car with them". You can't simply solicit others to drive your car for you and expect your insurance to cover them.

Umbrella policies only protect the purchaser of the umbrella policy. They also require an underlying valid auto insurance policy. If it's determined that the underlying auto liability policy was obtained without full disclosure, the umbrella policy might refuse to pay.

Marital assets are arbitrated by the courts. A judge can award the car to one party or the other, or direct that it be disposed of. All Josh needs to do is tell the court he does not want the car. He would be under no obligation to keep up payments for the car or insurance.

The real mystery is why Megan is being so adamant that Josh not remove himself from the car's insurance and lease agreement? She already has the car, so why does she need Josh?

Didn't Megan say that her license is now technically reinstated? If that's true Megan, why would you need anyone else to drive the car? Post a pic of your valid reinststed license, that'll shut us up.

He’s need to draw up the separation agreement Megan has been trying to have happen to delegate bills and responsibilities. Him making 24k a year can’t even pay half of his entitled bills.
