If you look he seems to fire seven shots striking him then there is a slight pause as he adjusts his aim and fires an eighth shot which seems like the fatal shot because the victim jerks left and falls.

the cop in this case said he went to reach for his stun gun and accidentally grabbed his gun
that is a big difference from shooting a man fleeing from you and then being caught in a lie saying he has your stun gun and then being seen placing it near his dead body
