President Obama’s old Harvard Law professor, Laurence Tribe, said that he “wouldn’t bet the family farm” on Obamacare’s surviving the legal challenges to an IRS rule about who is eligible for subsidies that are currently working their way through the federal courts.

“I don’t have a crystal ball,” Tribe told the Fiscal Times. “But I wouldn’t bet the family farm on this coming out in a way that preserves Obamacare.”

The law’s latest legal problem is that, as written, people who enroll in Obamacare through the federal exchange aren’t eligible for subsidies. The text of the law only provides subsidies for people enrolled through “an Exchange established by the State,” according to the text of the Affordable Care Act. Only 16 states decided to establish the exchanges.

I read about this. Appeals after appeals. It will go to the Supreme Court again. Should be interesting to see the outcome.

Pro_ObumbleCare people are saying it was basically nothing more than a typo. LOL

Gotta love the Democrats.

They have their one chance to "fix" health care and they come up with a half-assed Rube Goldberg solution and then can't even get that right.

Thanks Obama!

There is a difference between an appeals court saying that subsidies on certain health insurance policies violate the Obamacare law and saying that the law itself is illegal. In the former case they are interpreting a law that they found valid. In the latter case they are finding the law itself invalid.

If only Republicans worked as hard to abolish tax subsidies to the rich as they do to the poor that need basic health care.

If only Republicans worked to improve the system and peoples health rather than tear down any attempt to do so. What a world that would be.

What tax subsidies do the rich get? Specifically.

1. State and local subsidies to corporations: An excellent New York Times study by Louise Story calculated that state and local government provide at least $80 billion in subsidies to corporations. Over 48 big corporations received over $100 million each. GM was the biggest, at a total of $1.7 billion extracted from 16 different states, but Shell, Ford and Chrysler all received over $1 billion each. Amazon, Microsoft, Prudential, Boeing and casino companies in Colorado and New Jersey received well over $200 million each.

2. Direct federal subsidies to corporations: The Cato Institute estimates that federal subsidies to corporations cost taxpayers almost $100 billion every year.

3. Federal tax breaks for corporations: The tax code gives corporations special tax breaks that have reduced what is supposed to be a 35-percent tax rate to an actual tax rate of 13 percent, saving these corporations an additional $200 billion annually, according to the U.S. Government Accountability Office.

4. Federal tax breaks for wealthy hedge fund managers: Special tax breaks for hedge fund managers allow them to pay only a 15-percent rate while the people they earned the money for usually pay a 35-percent rate. This is the break where the multimillionaire manager pays less of a percentage in taxes than her secretary. The National Priorities Project estimates this costs taxpayers $83 billion annually, and 68 percent of those who receive this special tax break earn more than $462,500 per year (the top 1 percent of earners).

5. Subsidies to the fast food industry: Research by the University of Illinois and UC Berkeley documents that taxpayers pay about $243 billion each year in indirect subsidies to the fast food industry because they pay wages so low that taxpayers must put up $243 billion to pay for public benefits for their workers.

6. Mortgage deduction: The home mortgage deduction, which costs taxpayers $70 billion per year, is a huge subsidy to the real estate, banking and construction industries. The Center of Budget and Policy Priorities estimated that 77 percent of the benefit goes to homeowners with incomes over $100,000 per year.

7. The billions above do not even count the government bailout of Wall Street, while all parties have done their utmost to tell the public that they did not need it, that they paid it back, or that it was a great investment. The Atlantic Monthly estimates that $7.6 trillion was made available by the Federal Reserve to banks, financial firms and investors. The Cato Institute estimates (using government figures) the final costs at $32 to $68 billion, not including the takeover of Fannie Mae and Freddie Mac, which alone cost more than $180 billion.

8. Each major piece of legislation contains new welfare for the rich and corporations. The Boston Globe analyzed the emergency tax legislation passed by Congress in early 2013 and found it contained 43 business and energy tax breaks, together worth $67 billion.

9. Huge corporations that engage in criminal or other wrongful activities protect their leaders from being prosecuted by paying huge fees or fines to the government. You and I would be prosecuted. These corporations protect their bosses by paying off the government. For example, Reuters reported that JPMorgan Chase, which made a preliminary $13-billion mortgage settlement with the U.S. government, is allowed to write off a majority of the deal as tax deductible, saving the corporation $4 billion.

10. There are thousands of smaller special breaks for corporations and businesses out there. There is a special subsidy for corporate jets, which cost taxpayers $3 billion a year. The tax deduction for second homes costs $8 billion a year. Fifty billionaires received taxpayer-funded farm subsidies in the past 20 years.

If you want to look at the welfare for the rich and corporations, start with the federal Internal Revenue Code. That is the King James Bible of welfare for the rich and corporations. Special breaks in the tax code are the reason that there are thousands of lobbyists in the halls of Congress, hundreds of lobbyists around each state legislature and tens of thousands of tax lawyers all over the country.

WASHINGTON, July 22 (Reuters) - The U.S. Court of Appeals for the Fourth Circuit upheld a federal regulations that implemented subsidies that are vital to President Barack Obama's healthcare overhaul, in direct conflict with another ruling on the issue handed down earlier on Tuesday.

A three-judge panel unanimously said the law was ambiguous, and that it would defer to the IRS's determination that subsidies could go to individuals who purchased health insurance on both federal and state-run exchanges.

A separate panel from a federal appeals court in Washington on Tuesday morning said the IRS could not offer premium tax credits to people who purchase insurance through the federal insurance marketplace that serves most of the 8 million consumers who have signed up for private coverage for 2014. That list doesn't even include oil and big farm subsidies. Yet alone the federal reserve system and pretty much free money for banks to profit on from interest.

Something like 93% of farm subsidies go to agribusiness... but remember, the big bad government only wants to screw over businesses.

Creating bigger problems to solve smaller problems?

“But we have to pass the [health care] bill so that you can find out what’s in it....”, Pelosi.

Obama Care was a Republican creation and a Democratic compromise to address the bigger problem of uninsured Americans and inflating insurance costs.

It was passed after it left a bipartisan senate committee that took a year to reach a consensus on the Affordable Care Act.

So don't get the fucking game mixed up. You're do nothing assholes is all it is.

LOL! Yeah, after it left a 'bipartisan' committee which completely excluded any Republican input and the only 'consensus' reached was on the part of Democrats.

Why do you even type such stupid shit? Everyone remembers that the Dems had a majority and told Republicans to sit down and STFU. "Elections have consequences." Remember?

Gerrytard, so when did you sign up for Obamacare?

He won't answer because he hates people and wants to deny them healthcare.

1912
Former President Theodore Roosevelt champions national health insurance as he unsuccessfully tries to ride his progressive Bull Moose Party back to the White House

1935
President Franklin D. Roosevelt favors creating national health insurance amid the Great Depression but decides to push for Social Security first

1942
Roosevelt establishes wage and price controls during World War II. Businesses can't attract workers with higher pay so they compete through added benefits, including health insurance, which grows into a workplace perk.

1945
President Harry Truman calls on Congress to create a national insurance program for those who pay voluntary fees. The American Medical Association denounces the idea as "socialized medicine" and it goes nowhere.

1960
John F. Kennedy makes health care a major campaign issue but as president can't get a plan for the elderly through Congress.

1965
President Lyndon B. Johnson's legendary arm-twisting and a Congress dominated by his fellow Democrats lead to creation of two landmark government health programs: Medicare for the elderly and Medicaid for the poor.

1974
President Richard Nixon wants to require employers to cover their workers and create federal subsidies to help everyone else buy private insurance. The Watergate scandal intervenes.

1976
President Jimmy Carter pushes a mandatory national health plan, but economic recession helps push it aside.

1986
President Ronald Reagan signs COBRA, a requirement that employers let former workers stay on the company health plan for 18 months after leaving a job, with workers bearing the cost

1988
Congress expands Medicare by adding a prescription drug benefit and catastrophic care coverage. It doesn't last long. Barraged by protests from older Americans upset about paying a tax to finance the additional coverage, Congress repeals the law the next year.

1993
President Bill Clinton puts first lady Hillary Rodham Clinton in charge of developing what becomes a 1,300-page plan for universal coverage. It requires businesses to cover their workers and mandates that everyone have health insurance. The plan meets Republican opposition, divides Democrats and comes under a firestorm of lobbying from businesses and the health care industry. It dies in the Senate.

1997
Clinton signs bipartisan legislation creating a state-federal program to provide coverage for millions of children in families of modest means whose incomes are too high to qualify for Medicaid.

2003
President George W. Bush persuades Congress to add prescription drug coverage to Medicare in a major expansion of the program for older people

2008
Hillary Rodham Clinton promotes a sweeping health care plan in her bid for the Democratic presidential nomination. She loses to Obama, who has a less comprehensive plan

2009
President Barack Obama and the Democratic-controlled Congress spend an intense year ironing out legislation to require most companies to cover their workers; mandate that everyone have coverage or pay a fine; require insurance companies to accept all comers, regardless of any pre-existing conditions; and assist people who can't afford insurance.

2010
With no Republican support, Congress passes the measure, designed to extend health care coverage to more than 30 million uninsured people. Republican opponents scorned the law as "Obamacare."

2012
On a campaign tour in the Midwest, Obama himself embraces the term "Obamacare" and says the law shows "I do care."

Two GOP judges" didn't destroy anything. The D's who drafted the law intentionally wrote it in a way which they thought would force states to set up their own exchanges. When 2/3 of the states declined, those same D's regretted how they wrote it and now call it a "drafting error." If you want to be mad at somebody, be mad at either the the D's who pushed this poorly written and massively unpopular law through, or if you can't bring yourselves to do that then be mad at the GOP congress for not fixing it.

The judges who merely ruled that words actually do have meaning shouldn't be your target.
