A 75-year-old protester who struck his head on pavement after being shoved by police remained hospitalized Tuesday with a fractured skull, his attorney said.

Martin Gugino's lawyer has told media outlets in recent days that he had not yet been able to walk. Attorney Kelly Zarcone said in an email Tuesday there was no change in his condition and that she expects only gradual improvement.

Two Buffalo police officers have been charged with second-degree assault after a widely shared video captured Gugino falling to the ground after being pushed on June 4. He was seen bleeding from his head as officers walked away.

If the phone was a "scanner" (rather than, say, a camera recording the cops actions) and the old guy had a more nefarious purpose than, say, protesting police brutality, You don't think the cops themselves would be offering this as a defense?

It is illegal to use force (assault other citizens) to 'protect' a statue that is public property.

Holding a phone is not a crime. Still a free country. Id expect something along the lines of 50 million judgement appealed down to something in the 20 million dollar range. Great for his kids and grand kids I suppose. Another example why qualified immunity should be eliminated.
