Immigration officials are cracking down on businesses that employ foreigners, according to new data released by U.S. Immigration and Customs Enforcement.

ICE opened audits on 2,282 employers to make sure their employees were legally allowed to work in the U.S. between October and May of 2018, . The numbers are up significantly from the 1,360 audits opened during the last fiscal year, between October 2016 and September 2017.

Workplace arrests also increased significantly, according to the data. Between October and May, ICE made 594 criminal and 610 administrative worksite-related arrests, up from the 139 criminal arrests and 172 administrative arrests made the previous year.

The new numbers were released just months after ICE publicly announced that it would begin heavy enforcement of a 1986 law that requires “employers to verify the identity and employment eligibility of their employees and created criminal and civil sanctions for employment related violations,” ICE.

“Our worksite enforcement strategy continues to focus on the criminal prosecution of employers who knowingly break the law, and the use of I-9 audits and civil fines to encourage compliance with the law,” , comparing the audits to the work the IRS does. “Worksite enforcement protects jobs for U.S. citizens and others who are lawfully employed, eliminates unfair competitive advantages for companies that hire an illegal workforce, and strengthen public safety and national security.”

Benner has plans for another round of workplace audits this summer, pushing the total number to more than 5,000, .

Ultimately, Benner said he’d like to audit up to 15,000 workplaces for illegal or improperly documented immigrants each year and create a Employer Compliance Inspection Center with at least 250 dedicated auditors.

The Immigration and Customs Enforcement agents put on their navy blue jackets and walked into a trucking company's office in Carson this week, sending waves of anxiety rippling through the building.

In the lobby, a nervous office manager greeted the team from ICE's Homeland Security Investigations, twisting a black pen in her hands like a wet towel. A second manager joined them.

"I see people with vests and cameras," he said with an anxious chuckle. "That's not good."

The visit is part of a renewed wave in ICE's efforts to crack down on illegal immigration in the Trump era. Federal authorities are stepping up audits of businesses, hoping to catch employers who hired those here illegally. The agency's acting director wants to increase work-site enforcement 400%, part of a much larger effort to identify and deport those here without proper papers.

During a five-day operation in the Los Angeles area that ended Thursday, more than 120 businesses were issued audit notices.

Officials said the purpose of the audits is twofold: to punish employers and employees breaking the rules as well as to discourage people from coming into the U.S. illegally for work, which critics have long said takes away job opportunities from citizens and legal residents.

Immigration enforcement officers are making 7-Eleven stores a target in their crackdown on employers who hire undocumented immigrants.

On Wednesday, agents with U.S. Immigration and Customs Enforcement descended on 98 7-Eleven franchise stores across the country, where they began audits and interviewed employees and managers, according to the agency.

Twenty one people suspected of being in the United States illegally were arrested.

"Today's actions send a strong message to U.S. businesses that hire and employ an illegal workforce: ICE will enforce the law, and if you are found to be breaking the law, you will be held accountable," Thomas Homan, ICE's acting director, said in a statement.

It's the largest worksite enforcement operation against an employer under President Trump, ICE said.

Civil penalties for knowingly employing unauthorized immigrants can range from $548 to $21,916 per violation. Repeat offenders and companies hiring a larger number of undocumented employees receive fines that are on the higher end of the range. Criminal penalties for employing undocumented workers can result in monetary fines and possibly jail time.

ICE's worksite enforcement actions resulted in $97.6 million in fines and forfeitures last year, up from $2 million in 2016. According to ICE, the spike was almost entirely the result of penalties incurred by Asplundh Tree Expert Co., which was fined a total of $95 million. ICE said it was the largest payment ever levied in a work site case. According to the agency's estimates, at least 10% of Asplundh's tree cutting unit was staffed by undocumented workers.



In a statement, Asplundh apologized to its customers and listed the corrective actions it had taken since the ICE audit, including hiring compliance specialists and implementing a photo ID system with face recognition technology.

Employers should not ask whether or not a job applicant is a United States citizen before making an offer of employment. For example, e.g., an employer cannot require only individuals the employer perceives as "foreign" to verify their employment eligibility or produce specific documents, such as Permanent Resident ("green") cards or Employment Authorization Documents. It is the employee's choice which of the permitted documents to show for employment eligibility verification. As long as the document appears reasonably genuine on its face, and relates to the employee, it should be accepted.

Because of potential claims of illegal discrimination, employment eligibility verification should be conducted after an offer to hire has been made. Applicants may be informed of these requirements in the pre-employment setting by adding the following statement on the employment application:

"In compliance with federal law, all persons hired will be required to verify identity and eligibility to work in the United States and to complete the required employment eligibility verification document form upon hire."

The Immigration Reform and Control Act of 1986 (IRCA) also prohibits discrimination on the basis of national origin by smaller employers (with 4 to 14 employees). IRCA prohibits retaliation against individuals for asserting their rights under the Act, or for filing a charge or assisting in an investigation or proceeding under IRCA. What would you have us do Gerry? Put them up in a hotel? The parents are entering the country without permission or documentation. That's a crime. When a person commits a crime they are "detained" in a jail or adult detention center of some sort. Typically children don't accompany their mother or father to jail in this country.
