We're currently at 19 out of 50 signatures to have William Moreno investigated by the FBI. Every signature counts. This guy is a danger to children. His former postings are sufficient enough to prove that he has fantasized about committing dangerous homicidal acts against children. It's only a matter of time before he acts out on these fantasies. Unless there are some significant details that haven't been mentioned on here, it would appear to be dischargeable in bankruptcy.

I suggest you get a lawyer that knows the laws of Virginia and bankrupty.
Bankrupty won't work and I doubt a judge is going to hear another trial. Not to mention I doubt eesh has the money to pony up for a new lawyer.

Eesh could negotiate some new payment plan if the Morenos want to help eesh. Some how I doubt the Moreno's will let eesh off the hook.

Eesh can file for Chapter 7 Bankruptcy and the Leisers can object. However the Bankruptcy Code section 523(a)(6) exemption for willful and malicious injury is not for hurt feelings. In Kawaahuau v. Geiger the Supreme Court stated that the injury itself must be willful. A willful act alone is not sufficient; if eesh did not act willfully to cause an injury, the debt is dis-chargeable.

By the way William, but you are already in violation of the Fair Debt Collection Practices Act.

Also check out In re Markowitz.

Circuit Court held “that unless ‘the actor desires to cause consequences of his act, or … believes that the consequences are substantially certain to result from it,’… he has not committed a ‘willful and malicious injury’ as defined under § 523(a)(6).” In re Markowitz, 190 F.3d at 464. In other words, the defendant must have intended to cause the actual injuries, not just the act that led to the injuries.

In Tinker v. Colwell the Supreme Court defined “Malice” for purposes of § 523(a)(6), as “a wrongful act, done intentionally, without just cause or excuse.”

The Morenos would need to prove all of that, which would not be easy. Of course if Eesh tries to represent himself again, he is toast.

The jury verdict refers to the acts, whereas the bankruptcy exemption question relates to the consequences of those acts. The aforementioned jury only needed to find that the acts themselves were willful and resulted in injury.

Based on the Supreme Court's unanimous 1998 Kawaauhau v. Geiger decision, the debt is dischargeable. The Morenos would need to file an adversary proceeding and then try to make their case. Of course if eesh tries to represent himself again he will almost certainly fail.

There is plenty of evidence in the Mr. Misery posts that he was already distressed and suicidal long before. Just do a search on Mr. Misery for the word "suicide" and for the word "kill". Based on those posts that Miz admits to making, it's a wonder the police didn't show up at his house 10 or 15 times.

Furthermore, Miz's graphic death threat and the messages he sent to Megan clearly show Moreno was actively engaged in a feud and plotting against eesh even after he was allegedly "injured".

A woman won $430,232.20 judgement for some pretty extreme sexual harassment. The debtor filed for Chapter 7 bankruptcy and had the debt discharged.

Although he might make a case it is protected speech, eesh is wisely not adding his name due to the threat of additional persecution by the Morenos. I applaud eesh for this smart move. The Morenos have harassed and wronged enough people to make up the difference.
