Michael Josef Basl has five charges of violating protective order. Each charge has witness and computer forensics to back up his guilt. He is also facing the charge of violating his probation/pre-trial conditions.


What is the Penalty for Violation of a Protective Order in VA?

Violation of a Protective Order is a Class 1 Misdemeanor, which has a maximum penalty of up to 1 year in jail and a fine of $2500.

The punishment for any person convicted of a second offense of violating a protective order, when the offense is committed within five years of the prior conviction and when either the instant or prior offense was based on an act or threat of violence, shall include a mandatory minimum term of confinement of 60 days. Any person convicted of a third or subsequent offense of violating a protective order, when the offense is committed within 20 years of the first conviction and when either the instant or one of the prior offenses was based on an act or threat of violence is guilty of a Class 6 felony and the punishment shall include a mandatory minimum term of confinement of six months.

He will get 3 months max. This was a non violent protective order and is a waste of taxpayers money. Protective orders were created for battered women and violent offenders. This is a case of Internet butt hurt.

Eesh waited in the parking lot for over an hour for the Moreno family to come out, first of all.

Secondly, honking a horn and giving the middle finger to people who have a protective order against you and then doing the same while driving on the road is very much a violation.

Not to mention it doesn't help that there's pictures of the crime and the fact that he intentionally sat in the parking lot waiting for them to come out could count as stalking.

So something happening in the real world goes a little beyond your theory of Internet butt hurt, now doesn't it?

If that's accurate, he could do some real time for it. If that's what he did, it's called "lying in wait", and judges hate it. By real time, I do mean like what was said above, like 90 days to 6 months. That's real time. It changes you, and most people who have that happen to them, don't do it again.

The honking was, at a minimum, illegal. It is "unlawful for any person at any time to use a horn otherwise than as a reasonable warning." Va. Code ยง 46.2-1060.

The honking was an intentional act intended to cause emotional distress.

The honking was an escalation: deliberate use of an automobile as a weapon to stalk and harass, in a way that could very easily have caused an accident.

Last but not least, the honking was a "fuck you" to the judge who issued the protection order.

Since it is now clear that a protection order is not going to stop the bad behavior, the only recourse left is punishment. I.e., serious time. I.e., jail therapy.

That is true, I don't know about 3 months, but if he does get a fairly short stretch, that could happen. I was involved with a protective order case a few years ago. The guy just couldn't stop contacting the woman. He would get 5 days, 10 days, whatever. Finally, he hit a wall with the court, and got 5 years. And in Virginia, remember, if you get five, you pretty much serve five.

This guy is going down a road that could ruin his life.

I'm not sure I understand his current situation as to what he did. As I read the posts, he found out there was a third warrant out (surely from Fairfax), and he went to the Henrico sheriff and turned himself in. When he was arrested last time in Henrico, it took the system 3 or 4 days to get him up to Fairfax, where he quickly got in front of a judge and got out right away. You would think he would know that what he should do was arrange to turn himself in in Fairfax. That way, he gets in front of a judge in 24 hours, and probably, or at least hopefully, gets out on bail. What's happening to him now is that he's just waiting to be transported to Fairfax. It can be a long fucking wait. It's not as if that's a priority for the system.

He either did a bonehead move by going to Henrico to turn himself in, OR, he's even more fucked up.

Can anyone guess why he would WANT to spend a few days in the Henrico jail? Answer comeing soon.

The first two violations were out of Fairfax for stalking, horn blowing, giving middle finger and road chase.

He turned himself in after lizzie called the warrant desk and informed him that he had a warrant. He believed he could go and lie his way out of it and be processed in released.

Little did he know, Fairfax magistrates know his name very well and requested no bond.

The next 3 are out of Loudoun. His bond from Fairfax was revoked so he won't be getting a bond again. These violations are for posting about the Moreno's dead cat. Apart of the protective order prohibits him from posting about them, dead cats included.

That is contempt of court. He won't be getting out any time soon. He also wasn't aware of the last three charges until the Jakes came knocking.

Basl also won't be getting any 5 or 10 day sentences. The max is one year and the fact that he continued to break the law and taunt the system, his many victims and think he could get away with it won't help his case any. He is a danger to the public and there is no reason he needs to be in society, he serves NO purpose.

Most people don't do it again
Michael Basl isn't most people. He'll be back anon. He has nothing else. Without professional help he will continue his spiral. And if he loses the moreno suit then he'll really lose it.
He has really destroyed himself. Even though he got what he deserved, its really sad that a person can be so consumed with a stranger. Eesh busted Moreno's balls on his craziness and has turned out to be much crazier

You're wrong about a bunch of stuff. The first two violations were for violations of the protective order. Blowing the horn, giving the finger, etc. is salad dressing. He violates the order if he violates the terms of the order, and believe me, the order don't say shit about blowing horns or giving the finger.

You can't lie your way out of a warrant with a sheriff. The warrant is with the sheriff not the magistrate. It's after you get served with the warrant (meaning put under arrest) that IF you get taken to the magistrate, and it would be an Henrico magistrate, not a Fairfax magistrate, that IF The Henrico magistrate even sees it, he looks at it and says, this is a Fairfax warrant. Send him to Fairfax.

There is no contempt of court here. That's a totally different thing.

I think this guy believes that, in the end, he will be suing the Morenos and their attorney for malicious prosecution, and that he'll get a huge verdict and be set for life. A few days in jail adds to his damages, he figures, and it's well worth it.

He's very wrong.

The violations were the horn blowing and road rage. It counts as making contact but is also now being looked into as a stalking charge. Either way he's guilty.

I'm well aware of what a warrant is and who handles it. You are forgetting that this is the logic of Michael Basl. He thought if he went and talked he'd be let go and given a court date to go to Fairfax.

He was unaware that Fairfax magistrate issued the no bond. And you can say what you will about that but this is coming straight from the horse's mouth. The horse is a liar but whatever, it doesn't matter. He set himself up and it's great!

That's exactly what happened after he was transferred and the same thing will happen whenever Loudoun sees fit to go get him, which can be up to 30 days lmao!
