Dharun Ravi is not charged with murder: he's being charged with invasion of privacy, hindering apprehension, tampering with a witness and evidence and two counts of bias intimidation, the last two of which are the most serious and are why Ravi is looking at doing a double sawbuck in the joint.
See New Jersey Statutes Annotated 2C:16-1, Bias Intimidation for the actual statute, but basically it says that if you commit any one of a whole slew of crimes and you do them with the intent to intimidate another person because of their race, color, religion, gender, handicap, sexual orientation, or ethnicity, you get an enhanced sentence for the underlying crime.
It's like a special sauce for the steaming shit sandwich New Jersey makes you eat if you commit a crime and do it to harass or intimidate someone.
