There is something really wrong with this picture... I understand what they think they are trying to do, but I don't get the implementation at all. It seems counter-intuitive to solving the problem, and looks to create even worse problems.

So.. most voters were white... and white candidates always won. Somehow it seems the obvious question here is, why were the Hispanic folks not voting? Intimidation? Just plain not understanding the system? etc...?

I like the idea of cumulative voting actually, if done right. I'm not sure if they're doing it right in this case though. The way I understood it was you kind of rank your candidates, so say some of your votes goes to X, and some of your other votes go to Y, but that's when there are several candidates instead of our usual 2. The pool is eventually whittled down to the two front runners, so if one of them, say Y, gets eliminated, then your other votes move to your "second choice" candidate, say X.

I'm not sure if that's what they are doing here, and maybe I'm thinking of an entirely different system than "cumulative," but I like the idea. It's kind of an automatic runoff.

Lani Guinier's advocacy of cumulative voting was one of several things that shot down her nomination for Asst Atty General during the Clinton era.

If I could have put in "sotto voce" somehow I would have. It was meant to be the same as "who asked you eesh, stfu :)" I just decided to be more succinct in my delivery. My bad :)

"Cumulative voting" is essentially affirmative action in voting.

In an attempt to "level the playing field" for minority voters, the government favors certain racial and ethnic groups (eg, it "help(s) boost Hispanic representation") and disfavors others.

Cumulative voting thus requires the government to engage in active discrimination.

But the intent of the Voting Rights Act was to force the government to stop engaging in discrimination by implementing racially neutral rules - i.e., to achieve "a level playing field" through procedural fairness.

Judge Robinson's dubious interpretation of the law constitutes a return to the kind of government-mandated racial favoritism that the Voting Rights Act was intended to abolish. It plainly contravenes the rule of equal protection under the law guaranteed by the 14th Amendment.
