Is it statutory rape if the girl is over 18 physically, consents, but has the mental capacity of a 8 or 9 year old?

My vote is that itt would not be statutory rape.

Depending on your relationship with the girl, it could be a different charge, however. If she were diagnosed with some developmental disability, and you were responsible for looking after her, it could be considered something along the lines of abuse or exploitation.

Even if you weren't her care-taker, I would advise to find a different woman. Women like that are very unstable and unpredictable. If she got mad at you, she could accuse you of raping her. That would make it your word versus hers. Even if you were found not-guilty it would be an ugly process and an ugly blemish. Best to avoid these types of situations.

Stop going to Melwood to pick up women.

>Is it statutory rape if the girl is over 18 physically, consents, but has the mental capacity of a 8 or 9 year old?<

I see it would be in the state of Kentucky - their law has a specific provision that covers "incapacity to consent by the victim," which includes the mentally retarded.

I haven't found the relevant VA law to see if there's an analogous provision, and don't feel like wasting any more time on it.

But remember kids...

Why are you asking? Are you a finalist on Daisy of Love?

You know you're a statutory rapist if...

- you post questions on discussion boards like "Is it statutory rape if the girl is over 18 physically, consents, but has the mental capacity of a 8 or 9 year old?"

Just the other day, I was walking out of a restaurant with my girlfriend when she said, out of the blue, "you're such a pedophile".

I looked at her and said, "Pedophile? Pedophile?!? That's such a big word for a 10 year old!"

I apologize for introducing that shit-storm show into your awareness.

We'd all be better off if we never knew that show even existed.

I curse you everytime I see it listed in the guide... If it weren't for you I could see "Daisy in Love" and just keep scrolling without any extra thought. But YOU!!! You put a face to the name, so to speak. Now, every time I see the name, that FUCKING clip you linked to plays over and over in my head. That dude's shitty song that she thought was the absolute greatest.
I'm going to go sniff metal filings now...

I've had even worse ideas than sniffing metal filings, because of that show.

I think I actually experienced a brain cramp the first time I stumbled upon that show.

I've had thoughts of driving a nail into my temple, and diving into a vat of boiling hydrochloric acid. On my less manic days, I've contemplated the idea that I could hit myself over the head with a hammer so that I would feel comparatively better once I stopped.

If I were a violent person, I might have thought about doing a columbine or Cho on the filming location of that show.

That show just proves society is going down the wrong path in so many ways.

+1. That show is beyond a train wreck. The train has already crashed into another one and this show is the third train plowing into the existing wreckage. I've been mesmerized by the show here and there for about 20 minutes total and can tell you the following:

1. She's dumber than a than box or rocks.
2. Every guy on there is a complete tool and gives the rest of us men a bad name. I'm not really a violent person, but I'd like to kick the shit out of every one of them, at a minimum for just for dressing the way they do. Douches.
3. Ricki Rachtman has proven himself to be a complete sellout.

I curse seeing it on my DirecTV guide.
