Daycare worker arrested on three charges, including child cruelty

Fanny Raquelina Romero Henriquez, 29, of Leesburg, was arrested on counts of child cruelty, child neglect, and failure to report an incident to child protective services on May 6, according to Lt. Jeffrey A. Dubé of the Leesburg Police Department.

Henriquez, employed as a teacher at Kiddie Academy child daycare center on Sycolin Road, did not notify child services that a child under her care required medical attention from injuries sustained during an incident until eight days after it occurred. According to Dubé, she should have reported the incident within 72 hours.

“Failing to properly report the incident was just one of the charges,” Dubé said, adding that the other two charges were brought on from allowing the incident to happen.

Further details of the incident are unvailable.

“In juvenile cases, we don’t generally reveal many of the details regarding the specifics of the case,” Dubé said.

Dubé did disclose that the infant did require medical treatment, but is recovering from the incident.

The Leesburg Police Department and Loudoun County Child Protective Services are investigating—and claim the owners of Kiddie Academy are cooperating fully.
Henriquez was released following her posting a $7,500 bond.

I love how reporters never follow-up on stories. Technical Assistance:
Discussion of the incident that took place on Thursday, May 21, 2011. Interviews were conducted in conjunction with local law enforcement, and another local agency. Based on the findings issued on the violation notice of this same date, further disciplinary action; up to the denial of the current license, may occur.


Comments:
The following took place between the hours of 2:30 pm and 6 pm. Standard #: 22VAC15-30-430-A
Complaint related: No

Description: Staff #1 and Staff #2 failed to ensure the care, and protection of Child #1 on Thursday, April 21, 2011, within the Infant 1 room of the center. Evidence - According to the verbal statements given during the interviews of Staff #1 and Staff #2; and of the partial observation of the recorded video surveillance of the Infant Room, on Thursday, May 21, 2011 at approximately 9:49 am, Staff #1 attempted to turn off the bottle warmer while holding Child #1. In the process of turning this equipment off, Staff #1 caused the bottle warmer to tip over; allowing the boiling water from within to spill and splash out. This directly resulted in Child #1 sustaining the injury of a 2nd degree burn to his right foot. Staff #2 witnessed the accident and decided with Staff #1 to not report the accident or injury to the the Director of the center, Parents of Child #1, or calling emergency services in order to provided the necessary medical care for this seven (7) week old infant. With the injury occurring at 9:49 am, Child #1 received no direct first aid care at all, until after his 4:37 pm pick-up time when his own parents took him to the hospital. It should also be noted, that after a review of Staff #1 and Staff #2's files, both hold certifications in Basic First Aid. Staff #1's certification is from the American Safety and Health Institute (ASHI) and is set to expire in January of 2012. Staff #2's certification is from the National Safety Council and is set to expire on December 5, 2012.

Action to be Taken: According to the Management, the video surveillance was limited to the extent that when the accident occurred it was not in full view of the room camera. Therefore, any action that was taken was determined by the initial statements given to the Director by Staff #1 and Staff #2. Had the true nature of the child's injury been accurately reported, the management and administration of the center would have taken all necessary actions. Both Staff #1 and Staff #2 were terminated from employment on 05/04/2011. Training will be administered for all staff on the topic of care, and protection. Also, all like bottle warmers will be discarded and replaced with crock pots, and the procedure of taking the child to the heating device will be changed to now reflect the staff person bringing the bottle from the crock pot to the child. All staff will be trained by and this procedure will go into effect by Monday, May 9, 2011.

Description: Staff #1 and Staff #2 failed to notify the parent immediately that Child #1 sustained a serious injury on Thursday, April 21, 2011. Evidence - No notification was immediately given to either Parent of Child #1 after the child sustained his injury at 9:49 am. Staff #1 deceived the Parent of Child #1 by not reporting to the Parent that her child had sustained a 2nd degree burn. Instead, Staff #1 claimed (to the Parent) at the child's 4:36 pm pick-up that she only recently noticed the child's blistering foot around 3:30 pm. Staff #1 also stated to the Parent that her own child suffered from blisters and that her doctor said that they were common. Once home, the infant was taken (by his parents) to the emergency room where he was later admitted to the hospital.

Action to be Taken: Both Staff #1 and Staff #2 were terminated from employment on 05/04/2011. Training will be administered for all staff on the topic of emergency situations and when to contact the parents of a child as it directly relates to both serious and minor injuries.

Description: The center did not maintain a written record on the day of the occurrence, Thursday, May 21, 2011, of Child #1's serious injury. Evidence - No report of the accident sustained by Child #1 was documented by either Staff #1 or Staff #2. It was the belief of the Director, as reported to her by Staff #1 and Staff #2, that Child #1 only sustained a minor injury and not one of a serious nature. Based on the interviews of Staff #1 and Staff #2, both realized that the child sustained a burn that resulted in redness and blistering; one of a serious nature, yet both chose not to report or document it as such.

Action to be Taken: Both Staff #1 and Staff #2 were terminated from employment on 05/04/2011. Training will be administered for all staff on the topic of the documentation of both serious and minor injuries. An accident/injury report will be retroactively created for this incident.

Description: Staff #1 and Staff #2, in their professional capacities as persons providing full-time or part-time child care for pay on a regularly planned basis, and who had reasons to suspect that Child #1 was being neglected, failed to report the matter immediately to the local department of the county or city wherein the child resides or wherein the neglect had occurred or to the Department's toll-free child abuse and neglect hotline. Evidence - Neither Staff #1, who accidently caused the incident that resulted in the 2nd degree burn of Child #1, nor Staff #2, who witnessed the accident, made a call to the County of Loudoun, Child Protective Services' hotline or to local law enforcement; thus failing to fulfill their responsibilities as mandate reporters as stipulated under this subsection of the Code of Virginia. It should also be noted that after a review of both staff files: Staff #1's file contained a training certificate dated - 07/12/2005. The title of this course was "Child Abuse and Neglect: Recognition, Reporting, and Responding for Educators." This course was offered by the Department of Family Services: Fairfax County Child Protective Service and was in cooperation with the Virginia Department of Social Services. In addition, both Staff #1 and Staff #2 completed an online course. This online training was title - "CWE5691: Child Abuse and Neglect: Recognizing, Reporting, and Responding for Educators." This course was offered by the Virginia Institute for Social Services Training Activities (VISSTA) and was taken by Staff #1 on 04/20/2011, and by Staff #2 on 03/25/2011. These online courses were separate from their orientation training (with regards to being a mandated reporter); for Staff #1 this orientation training was dated - 04/18/2011, and for Staff #2 this orientation training was dated - 03/23/2011.

Action to be Taken: Both Staff #1 and Staff #2 were terminated from employment on 05/04/2011. Training will be administered for all staff on the topic of mandated reporting. Such training will be conducted in person and by a representative of Child Protective Services.
