First off, these are nothing but unproven allegations. I have no idea who took that picture nor do I know where it was taken, and that's been my official story from the start. There is nothing here that would hold up in court, thereby preventing police from getting the necessary warrant to search my trash, which is perfectly clean anyway.

Not too long ago an Assistant Principal at Cub Run Elementary was busted for pot. It's not clear how the police first noticed him; I'm fond of the cool conspiracy theory that they used an infrared camera on a helicopter to detect houses that were "too bright" at night (signifying grow lamps) but I don't have any hard proof of that other than that was being done elsewhere in the same time period; that might be an unwarranted search now so isn't allowed, not sure.

In any case, once the police were interested in his house (like, say, they would be interested in the home of the poster of that photo up above), they "collected" his trash, searched it, found pot remnants (stems? Don't know. In any case, stupidity-incarnate on the perp's part), and using THAT as evidence, got a search warrant for his house...the rest is history.

At any rate, a simple check of the EXIF properties of the image will show that it was not processed in Photoshop and that it was taken with an LG Electronics model VX-9700 cell phone.

The next step for the police is to obtain a warrant to force Cary to disgorge the IP address that the picture was posted from, then another warrant for the ISP that allocated that specific IP address to reveal the address of the customer that was using it at that time.

This will probably lead to eesh, who will happily confirm that he did in fact obtain the image from Fairfax Underground, where it was posted by the user Ding an sich.

Armed with this information, the police will then obtain another search warrant to force Cary to give up all IP addresses used by the user Ding an sich, then more search warrants for the ISPs involved, since Ding an Sich likely posts from both his cell phone as well as his home. This will lead unmistakably to Ding an Sich's home address, where his trash will be gone through with a fine-toothed comb, and a police officer with an amazingly sensitive sense of smell to rival that of any bloodhound will be dispatched to ask questions of the now newly-nonanonymous Ding an Sich, who may also be invited to return with the officer for several hours of questioning.

If the officer smells anything that even remotely resembles the odor of cannabis, he will likely cite that as probable cause for immediately arresting Ding an Sich and conducting a search of his residence. The discovery of cannabis residue, scales, and plastic bags at Ding an Sich's house may prove sufficient to arrest and charge him with felony conspiracy to sell marijuana.

They may also conduct surveillance on Ding an Sich's residence, noting his comings and goings and those of his friends.

The police are not interested in you, however; they want to know who sold you the marijuana, so they will offer you a deal to snitch out your source or spend a few years in prison.

The question is, does the roughly 9 grams of marijuana shown packaged for sale in the picture above lead to the conclusion that the person who sold you the marijuana has sufficient weight to make all of the above worthwhile.

I predict you buy mostly ounces and half-ounces (although it's possible you buy up to a quarter pound, but I doubt it; you'd sell eighths and quarters then, not dime bags), smoke some and sell the rest to your friends and buddies to maintain your marijuana habit. This would mean that the person you buy from buys in weight at about 4-16 ounces, likely.

You're most likely a college student so I'd say you're 21 years old, +/-2 years. You're not a residential student, however, you live with your parents, and your father is likely retired military, or close to retirement.

Just some thoughts off the top of my head.

BTW - as THIS post shows, IDs don't mean squat - however, IP addresses DO mean something. The photo was posted by some ID or other. The IP address, however, probably is matched by OTHER contemporary posts by the same person, different ID. ALL those are obtainable by subpoena fairly easily (from what I understand - admittedly secondhand).

The same way we were able to figure out who Ashton was. We are smart here. Unlike ding. He posted that pic and was telling eesh to do drugs and to chill out. I witnessed this first hand. Also how can he explain the picture having his username in the pic as well as being posted from his username? He took the photo and is IP address is located in the town of Vienna. His name has also been posted here and this isn't the first time he has bragged about his use of drugs. If someone really wanted to they could contact non emergency police over this.

There's a difference between someone who's growing/possibly distributing weed and the causal consumer/user. If he's not growing/selling then they don't care... to a degree. I'm sure you know that most drug busts are 'profitable' for police (e.g. amount of money spent on manpower < or = value of cash and property seized). If police went around busting small time users then it would be difficult to prove in court that the various possesions they seized were obtained illegally therefore it would not be economically feasible to bust people like ding. Normally they don't go after small time users unless they recieve a complaint or witness something personally. Of course if ding is a drug lord, then he might be in trouble.

I have to admit I have literally zero experience with the actual court-side of drugs, etc. However, posts here, articles there, suggest just the PACKAGING can be evidence of drug selling (which seems pretty shaky to me, but I have literally no experience etc etc etc). The photo up above has multiple small packages that suggest to THIS naive viewer trouble for the person who took the photo (not necessarily anyone already mentioned in this thread, BTW).

The question is not the quantity so much as how it's packaged. The casual user keeps all his marijuana in a single bag, or sometimes a larger quantity in one bag and a smaller quantity in another container.

The casual user does not package his marijuana in multiple small bags.

There are 9 grams of marijuana visible in the picture, which means that the original quantity was likely 1/2 ounce, or 14 grams (Ding an Sich smoked the other three grams, which explains why he sent the picture to eesh).

This is a sufficient quantity for a class 1 misdemeanor prosecution under Va. Code § 18.2-248.1 (http://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+18.2-248.1), but not a felony prosecution, as I originally speculated. A class 1 misdemeanor is punishable by up to one year in jail, and although it is doubtful that Ding an Sich will serve a full year, ANY time in jail is too much time in jail, trust me.

This is also why the cops will push Ding an Sich to turn snitch, or face an expensive prosecution under the statute cited above. It'll probably cost a few grand to defend the charge, which Ding an Sich does not have, else he wouldn't be dealing dimes to his buddies.

Ding an Sich's one saving grace is that no one here will actually call the cops- they'll have to figure this one out for themselves.

I've been interogated by cops plenty of times, and I'm friends with plenty more. There's no evidence here against me. Any cop stupid enough to start looking into these allegations will only be wasting the taxpayers' money.
