Shovelling The walks

I keep hearing on the radio the you must clear the sidewalks in front of your home, but I have searched VA laws and the only thing I can find is a law that says municipalities MAY enact a law requiring clearing the walks and Fairfax County Government website says snow removal is not required by law.

My neighbors shovel the walk in front of their house but not the walk next to their house. I thought you were supposed to shovel the walks that may abut your property.

Anybody know of what the law really is?

Who is responsible for clearing snow from the sidewalks in my neighborhood?

Neither the Virginia Department of Transportation nor Fairfax County clears snow and ice from public walkways (sidewalks and trails). While not legally obligated, citizens and businesses are asked to help keep sidewalks safe. They should, as soon as feasible, clear snow off the sidewalks in front of their property so that all pedestrians, especially school children, those with disabilities, and the elderly, may walk securely.

Homeowner associations may require members of their communities to clear walkways abutting their property. Please contact your association or property manager for further information.

Ask the County of Fairfax this week if they regret attempting to clear a sidewalk at the courthouse and they might say they wish they left it alone.


Attempting to clear, reportedly was WORSE in a legal view than closing the courthouse and shoveling nothing.


A guy fell and sued for $300k and the county has offered a $100k settlement.

All because the county tried to clear it to stay open when most things were closed.


How dumb the legal system has become.

Mostly corect, Even in an HOA, I would have NO legal obligation to clear the sidewalks, as the HOA cannot by law, cover property thatis not theirs.

If the rights and docs run witht he land when roads were conveyed, then possibly so - But as a rule, no.

In many cases, side walks are deeded as easements on private property so if an HOA specifies that walkways on home owner property should be cleared, that would imply the sidewalk as well.

Radiophile, don't worry, I am sure the crew at Sunrise shoveled their facilities.

as per fox 5 news (discussing DC sidewalks)... residents could get away with not shovelling... if a business didnt.... they would be warned then fined..

i'm sure thats applicable in FFX county.. makes the most sense.
