I am 1 (one) point away fro suspending my driver's licence.

I just got caught by the policy for not properly stopping and turning and got ticketed for not wearing a seatbelt today.

The fine said, General District Court, Traffic, for violation of State, law section 462-1094: Describe Charge: No Seatbelt.

Do I get points for not wearing a seatbelt?

FWIW if you get two tickets and one is for a seat belt violation, some judges will throw out the seatbelt ticket if they find you guilty of the other one. Roll your dice and take your chances. Doesn't work though when it is a child not wearing a seatbelt.

For not wearing a seat belt, you pay a $25 fine and there are NO POINTS ASSESSED! See the Official VA Law regarding this here:

Where the VA Code § 46.2-1094 ,Section C, on that page reads:

"Any person who violates this section shall be subject to a civil penalty of twenty-five dollars to be paid into the state treasury and credited to the Literary Fund. No assignment of demerit points shall be made under Article 19 of Chapter 3 (§ 46.2-489 et seq.) of this title and no court costs shall be assessed for violations of this section."

Section F. Also says that this can only be a secondary violation:
"No citation for a violation of this section shall be issued unless the officer issuing such citation has cause to stop or arrest the driver of such motor vehicle for the violation of some other provision of this Code or local ordinance relating to the operation, ownership, or maintenance of a motor vehicle or any criminal statute."

This is the official code of VA as of today, 2/28/2012.

Just anyone who took the time to read the drivers manual, I understand its in about 200 languages now so you will know not to be wearing headphones and drive into the path of a 26 ton firetruck trying to get around you.

I don't feel bad because I (as part of our larger society) picks up the externality costs of your not wearing a seatbelt( which may be even dumber than smoking, given the dramatically increased health risk but no addictive component).
