One thing for sure about gun ownership at least you know exactly who the cowards are.

It seems that 90% of gun owners have a similar fantasy. The fact still remains that gun ownership makes you far more likely to be a victim of a crime or to do prison time. It is so sad that these mental midget gun owners continue to put themselves and their families at risk by owning guns. It think in most cases these gun owners were born cowards and their parents before them were also cowards. It is a cycle of cowardice that is very difficult to break.

Just saying, the reality of life is a lot different than theory.

I have actually had to use a handgun to prevent an individual from breaking and entering my home. And no I did not discharge the handgun during the encounter. The individual continued to attempt his forced entry even after being informed the Police were coming, that we were in the residence, that we had a large Golden Retriever who would attack any intruder (he was barking and snarling at the door as the blows continued) and finally, that I would not hesitate to defend myself if he entered the doorway. His response was to scream that he would kill my dog, my family and me once he entered the home.

With my door and frame about to fail, I opened the door and with my .357 revolver pointed at his face, I instructed him to step back from the door and await the arrival of the Police. If he failed to do so, he would regret that decision for the brief second it took for him to die.

After about 15 minutes, with the neighbors all out in the street watching and waiting for what would happen next, the Police finally arrived and arrested the individual. The officer asked me what I would have done if the individual had walked away, or if he had come into the house. My response was that no harm would have come to him if he had walked/run away; however, after entering my house, he would not have departed it alive. He smiled, shook my hand and departed.

Thankfully, I had installed a deadbolt lock on the front door after moving into the home. The lock and door sustained damage, enough I had to replace the lock, the door and the frame. The three prevented the individual from entering my home until I was able to step in. The dog and my presence were no deterrent, as the individual threatened to kill us all. The Police were no deterrent either, as he was not concerned that they had been called, and their arrival 15 minutes after I had to use my gun to stop the assault was very upsetting. Had I not had the handgun, he would have broken through the door and the Police would have arrived too late to do anything but the paperwork.

Fortunately for everyone involved, upon seeing the handgun pointed at his face he stopped his assault, stepped back, and waited until the Police arrived. Why my house he never did say, as I lived in a townhome community and to get to my house he had passed many others.

In this instance, the presence of a handgun and it's threat to be used was able to stop the assault and lead to the individual's arrest. Nobody was injured other than damage to the door, the lock and the door frame. The dog did not get to attack the individual and peace and quiet were eventually restored to the neighborhood.

Yes, it could have gone quite differently even with the handgun. Fortunately I did not have to discharge the handgun, but I was able to defend my family, my home and myself, something the Police were not able to do.

The legal answer to the question is simple. Absent statute lethal force can only be used to defend yourself or another from present threats to kill or commit serious bodily harm. Absent statute lethal force cannot be used to stop someone from damaging your property. Absent statute lethal force cannot be used to stop someone from committing minor assaults. Absent statute lethal force cannot be used to prevent someone from committing future serious assaults. That last restriction applies even when the threatened serious assault is likely to occur in the very near future. In some states there is also an obligation to retreat if reasonably possible before using lethal force, although this varies from state to state. Absent statute if the person using lethal force initiated or escalated the confrontation a present threat of serious assault is only a defense to murder, not manslaughter, unless certain specific circumstances exist.

The law provides when someone breaks into a residence that he has no claim to be in, the residents may assume that a present threat to commit serious assaults exists unless the circumstances indicate otherwise.

The correct thing to do was to wait until the assailant broke in. In choosing to open the door and confront the assailant you waived the right to rely on the presumption of a present threat to commit serious assault that would have applied if the assailant broke in. In choosing to open the door you, not the assailant, converted the threat to commit serious assault from a future threat to a present one. In choosing to open the door and confront the assailant you escalated the confrontation.

You technically committed murder. Even if a jury is disinclined to convict on the facts there is still a strong case against you for manslaughter. You were not defending yourself or others in your residence. You were defending your ego and your property.

The gentleman was threatening the life of the homeowner and making repeated efforts to break down the door. How does the homeowner waive their right to defending themselves if they open the door when it is about to break? The perpetrator verbally threatened the life of the homeowner and all occupants of the residence, so the homeonwer rightfully can open the door and prevent the attacker from entering.

The advantage that the homeowner has under the facts argued is that the law isn't mechanical. Rather the law is applied by a jury that has the ability to ignore the rules if they think it will result in an unjust or too severe of a conviction.

LOL! These cowardly gun owners seem to have his same fantasy about their wives getting raped while they are tied up or bleeding. For whatever reason the fantasy runs through their heads over and over.
I guess this fear within them is quite powerful so they go out and buy guns, usually multiple guns. The sad part is that in the end no rapist-attacker ever comes to their home and in most cases they end up using the guns on themselves or a family member. You are making the mistake of thinking the law in this area is based on the natural right of a person to defend himself. It isn't. It is based on the principle that if someone is going to die, then all other things being equal it is better for society that it be the victim of the assault rather than the assailant. The operative phrase here is "someone is going to die". The assailant pounding on the door may be unable to break in. The assailant may change his mind before he succeeds in breaking in. The assailant my be scared off by others observing the incident or by police intervention. The homeowner's proactive defense removes these possible alternative outcomes. Whether someone dies is no longer solely dependent on the further actions and choices of the assailant. That is why it is murder.

Several years back one of my co-workers shot a African American gentleman that was lifting the sliding glass door out of the track to gain access to my co-workers townhouse. He did not kill the intruder , he shot him in the belly. When the guy called 911 he was upset to say the least and he told the operator "I shot a ni@@er who was breaking into my house!" My co-worker was charged under the hate crime statute and he was given 5 years in the penitentiary he was placed on supervised release after 4 years. This fucked up his whole life. His wife left him and his kids would not see him so he blew his brains out last year.
A whole family destroyed all because of guns.

It’s a great thing to see that there were so many new gun owners who joined the Second Amendment community last year.

There were 8.5 million new gun owners, and the vast majority of them were African Americans.



The highest overall firearm sales increase comes from Black men and women, who show a 58.2% increase in purchases during the first six months of 2020 versus the same period last year.

But unlike what the media would like you to believe, this is nothing new. The right to keep and bear arms is a long-held and sacred human right for those in the African American community. And African Americans exercising that right is a long-held tradition.

Newly freed African Americans used firearms as a way to protect themselves on their own property against racist bigots who wanted to terrorize, intimidate and, at times, kill them.

It’s not uncommon to hear African Americans today talk about their grandfathers or great grandfathers’ shotguns passed down through the generations. These were shotguns they would use to fight back against domestic terrorist organizations like the Ku Klux Klan, an organization that began as a fervent gun control group.

Gun control is and has always been racist. It’s kept those most disadvantaged in society, disadvantaged. It has kept the most oppressed from being able to use the tools necessary to fight the oppressors.

It keeps people in most inner cities and beyond from being able to live with the peace of mind that if the unthinkable happens they have a way to level the playing field.

In 1956, Martin Luther King, Jr., tried to get a concealed carry permit after his home was bombed. But anti-gun Democrats denied his application then, and they’re still trying to deny people’s gun rights today.

This MLK Day, Gun Owners of America wants to reiterate our fight to preserve the human right to keep and bear arms for ALL.

All people. All arms. No compromise.

I have no problem with people owning them, so long as they keep them in their homes and businesses where they belong, and so long as they keep them properly secured if they have small children present. That is what I do. It is these jackasses that want to carry their firearms in public, on the highways, into parks, into bars and onto people's and businesses' property that scare me. The first proof that a person is mature enough to own a gun is the oerson having the maturity to know when it is appropriate to carry one (a hell of a lot less often than what many CC permit holders think) and when it is appropriate to display the firearm (almost never).

You would be shocked at how many guns exist around you in very close proximity every time you venture out. Just because you aren't capable enough to carry concealed doesn't mean that others aren't. Now that Fairfax county has banned guns on public property the next logical step is to ban guns on private property as well.
Those of us who believe citizens walking around with guns for "protection" is unnecessary as well, and potentially dangerous to the general public. I agree that this law would not necessarily prevent a shooting like the VA beach one from happening. But the absence of this law did nothing to save those people's lives either. The "good guy with a gun" scenario is so rare and unlikely and is not a good reason to allow regular people to act as citizen police and walk around armed "just in case." Let's leave that to trained security guards and police (and anyone who wants to respond to this, don't even start on "there will be no more police if Democrats get elected!" That is a bunch of propaganda BS and you'd know it if you bother to read up on it).

Additionally the county BOS can NOT carve out any exemptions for the retired officers , they are no longer agents of the government as they have retired, they are now ordinary citizens like everyone else , its unconstitutional to make any accommodation under the second amendment that law abiding citizens will NOT be allowed just for retired police as they no longer have any law enforcement authority under the law in the same way it is unconstitutional to make any special legal carve outs for races of people or religions or occupations, equality under the law for all is the law of the land This is why the LEOSA has the exemptions to where retired police officers can carry their firearms under the LEOSA act "illegal to carry for common citizens with a gun permit, illegal for retired police to carry who qualify under the LEOSA act "

When that happens we the loyal Americans to our flag and our US constitution will join with our limited US armed forces and fight the invading enemy back in a conventional guerrilla war .

If you think all guns are acquired thru legitimate means with background checks then your just living in a fantasy world. Take DC for instance, there’s shootings every day in that ghetto shithole and your not even allowed to buy a gun there! The only thing more laws do is penalize law abiding gun owners.
