Paraphernalia Question

Someone said in the "head shops" thread that it's illegal to sell glass pieces in VA... is this true?

Before any green has touched it- Exactly when does a piece stop being a tobacco pipe and start being paraphernalia?

i dont think its illegal to sell glass pieces in VA, but i do think it is illegal in fairfax county. They sell glass bowls and bongs in a little bodaga shop in manassas straight down 28 called Mathis. The bowls are out for every one to see, they r pretty nice to. If you want to see the bongs then you have to ask. It might take a couple of minutes untill they realize that u are not a cop. Water pipes and bowls are legal untill any pot resin touches it.

Nope, its illegal to sell glass pipes in virginia straight up. In Virginia Sale = up to one year in jail and a fine up to $2,500
Ive known about mathis for a while, hope its still there after you mentioned it here. They have nothing but cheap production glass pipes. Bubblers for $50 is a decent deal though, but they are not worked very well.
I do remember something about it being legal to sell if your not in an established store, but i couldnt find the actual law.

I thought Manassas mandated the selling of paraphernalia in every store? How are Manassas residents suppose to sell their products if there's nothing to smoke them in?

Selling fixed up wrecks alone will not keep Manassas going!

it is not illegal to sell tobacco water pipes
because they are intended for tobacco when they are being sold
Once a piece of THC gets burned into that glass, it is paraphenalia
if the pipe/whatever has not been used with THC. then it is a glass ornament you hang on your christmas tree or use as a vase for plants

Didnt Tommy Chong get federal time for selling them over the internet? I think he was threatened with his son going to jail with him and losing everything he owned so he took a plea bargin.

That's exactly what happened, he talked about it on Stern soon after he got out of jail. Basically, he either plead guilty to everything, or the cops would arrest his entire family for paraphenalia. He was railroaded bigtime.

I remember being in 7-11 late one night and this guy came in smelling like a thousands joints. He was very high and went to the freezer and got a big thing of ice cream. He took it to the microwave and cooked it for a minute then ate the whole thing in the store in about a minute. He paid for it and the clerk, an african guy, just looked like it was an everyday thing, which it prob was.

True, if you know your rights, a clean waterpipe would never make it past a judge. However selling them is quite different and it is illegal in this state to sell glass pipes. If you read what mad max JD posted and followed the links.. you would know.

If the pipe is dirty, ie has resin in it, in Fairfax County they'll charge you with possession of marijuana. Fairfax cops are all about upping the bar & getting the most bang for the bust, & it's best not to carry any amount of weed you can't eat quickly like a joint or 2. Blunts are inedible so they're a pretty bad idea.

The other thing to know is if you do get busted and it's a first time thing, they'll offer you a "diversion" program that'll get the charge dismissed. It's sort of a bad deal though because you lose your license for 6 months, have to do ASAP classes, and if you are caught driving, or are given a ticket (even driving to/for work purposes) on a restricted license, they'll charge you with a driving on a suspended (dwi) offense, that's got a mandatory 1 year license revocation $2500 fine, and up to a year in jail.

If you plead guilty to possession though, and it's a small amount, it's like a $250 fine, no jail, no loss of license, and no dwi crap to go with it presuming you wern't driving drunk or stoned like a total idiot. It's a lot better to just do that than expose yourself to getting jacked around for the better part of a year.

If the pipe's 100% clean they can still charge you with possession of paraphernalia, and probably will too if they're in the mood for it. Then you gotta go to court, get a lawyer, all that costly crap, & fat chance you're going to walk away without a conviction of some kind. That's just not how it works in Fairfax.

If you expect "justice" you're a fool, because it doesn't exist. What there is instead is a system that's very stacked against you once you're charged.

That's all so pointless. Shit rolling paper are paraphernalia then, and I know a paperclip poked into it can be interpreted as such. In a much friendlier jurisdiction my friend has gotten mj possession 3 times and never once did it end up on his record and he only had to go to court one time. He also got a ticket for paraphernalia possession (also had resin in it but that wasn't an issue, the cop even made a statement that it stunk). But the paperwork never made it down to the local courthouse when he showed up on his court day and they told him to forget about it.
