Warrant In Debt

I had a repossession last summer. Now this summer, I have received a summons for a warrant in debt. The bank already took my car! Now they want me to pay off the balance? I guess I did sign a contract at the dealership.. but how is this fair? I figure they either take the money or the vehicle-- not both. What do I do? Should I hire a lawyer? I have court in two weeks.

Pay your debt. How much is the debt? If you signed the contract, you are obligated to pay. Instead of getting a lawyer, you may want to try and call the creditor to waork out some settlement. Also, is this the first you heard that you owed them money? Did you ever get any demand letters?

I've scoured the Internet for weeks looking for solutions- I've even thought of bankruptcy. Who knows a good lawyer? Did I mention I am broke- hence a factor behind the repo.

I am trying to answer your question about whether or not to file bankruptcy. what is your TOTAL debt, not just vehicle. You can't declare bankruptcy and pay off one creditor.

You should call them and try and work something out, but if that does not work you can try this.

When you go to Civil court and your case is called, the judge will ask if all parties are represented or present in court that day. If they are, the judge will then ask if either of you wants to take it to Mediation. I would do that if I were you. The goal of the mediation is to try and resolve the situation so that it does not go to trial. Whatever you and your creditor decide on (if you do agree on anything) will be presented to the judge. If you abide by the contract you sign with your creditors that the mediators helped facilitate, you will not have a judgement on your credit report and you should be good to go.

Not needed. But, even a resident of Melwood knows that there are huge differences in implications between filing for Chapter 7 or 13 at 22 than at 32. So, what time is your Melwood van picking you up?

Thanks for the encouragement... Less than 25K a year, no assets, no collateral. Surely it went to auction and got sold dirt cheap. And why would they tell me about how much money it was sold for when the bank can collect more. But that is something I will mention hopefully so I can bring the debt down. Oh well..

You are only required to pay the difference between what you owed and what the car sold for. They may tack on some repo fees as well. I would not go into bankruptcy. I would try to work out a payment plan with the creditor. Was your debt sold to a collection agency or are you dealing with the original lender. Collection agencies pay less for the debt, so they may be willing to settle for less.

Here's my advice. Contact the lender. Ask to speak to a manager or someone in a position who can make decisions. Find out how much you actually owe (tell them you want to know what they got for the vehicle when they sold it). Even better, if you have the VIN, see if you can track down what they sold it for. Tell them you want to know what you really owe on it. Tell them that you are willing to work out a deal, but if you have to, you will get a lawyer involved.

Try that first and see what the number ends up being. If they don't budge off of the $12K, I would suggest meeting with an attorney and seeing if you can pay a couple hundred bucks for him or her to outline what you are willing to pay to settle the situation in a letter to the lender. Make sure you tell the lender that if they aren't willing to work out a deal, you may have to declare bankruptcy and they will get nothing.

Try that out and see what the lender says.
