Bad News Indeed. I have worried and hoped he would make it at least 5 more years. Scalia you were one of the Good Guys.

1. Now That Senate with some GOP members have confirmed two liberal Obama picks. They will not do that again . There probably will not be any Justice confirmed till the next president is in. Unless Obama appoints someone who both sides can agree on. A 50/50 Lib as such. But he will game the voters first.

2. Obama will appoint a liberal Spanish judge, knowing that the appointment will not be confirmed by the Senate to piss off the Spanish voters.

3. Obama will appoint a liberal Black judge, in the same way to piss off Blacks.

4. Obama may do the same with a Liberal Asian judge. And A White Woman.

5. Chief Justice Roberts will not allow some cases to be heard until there is a full court seated. Which means only some cases will be heard this year unless a Obama Justice is confirmed.

6. Until a new President is sworn in that's the way it will be. And thankfully the Next one will be a GOP President.

7. The News Media will have a Field Day with this Happy Days they are singing.

8. There will a lot of bitchen on FXU about this.

9. The GOP will hold the House and the Senate in 16 so. No new laws that are unconstitutional will be passed by Democrats.

10. Hillary will be brought to the bar of Justice in 2016 for sloppy handling of US Top Secret and above information and will not be the Democrat Canidate in Nov.16

Without a doubt, Eric Holder will be nominated. Barry already has two lesbians on the Court so no more are needed which rules out Janet Napolitano, who was considered a front-runner before. Holder is Obama's nigger and will step and fetch as directed...as he did as the most political attorney general ever. It is doubtful this scenario will occur, but it would be fun if it did. Sandra Day O'Connor retired to spend more time with her husband, who developed Alzheimer's. By the time her replacement was confirmed and she left the court, her husband, unfortunately, was very far gone and was, I believe, was getting 24-hour care at a facility in Arizona. Justice O'Connor is still a sharp legal mind, and like many retired Federal judges, helps district courts experiencing heavy caseloads. Suppose the President were to nominate Justice O'Connor? Would the Republican-controlled Senate repudiate a distinguished Republican judge, and simultaneously walk away from the opportunity to confirm the fifth female justice? Oooh...think about it.

A great deal of what I know about U.S. constitutional law came from a brilliant show on PBS in the 1980s called THE CONSTITUTION: THAT DELICATE BALANCE, hosted by former Supreme Court justice Potter Stewart. It was a round-table discussion in front of an audience with a wide variety of politicians, political journalists, lawyers, and legal scholars. Each week, a hypothetical case would be presented to these people and they would discuss and argue the merits of the case under the laws of the nation, each case chosen so as to enable questions of constitutionality. It was one of the best things television has ever offered, and I found it magnificently enlightening.

That show was where I first encountered Supreme Court Justice Antonin Scalia. He was erudite. He was charming. He was stunningly well informed. He was one of my favorite panelists on the show. It was only much later that I realized how dreadful I found his positions on actual court cases, how distantly opposite we were in our core beliefs about many of the cases coming before the court, how dangerous I found many of his ideas.

So today's news leaves me with mixed feelings. I cannot but rejoice that he is no longer a factor on the court. But he also taught me so much about what the American constitution means and how remarkable its creation and endurance have been for the country I have no doubt he loved as much as I do. I hope we who opposed his positions can respond to this news with notable grace.

The show first aired on The Learning Channel, it was produced by Columbia University, and the actual host was Fred Friendly, though an aging Potter Stewart did sit in to act as a sort of in-studio foil to Friendly, the veteran newsman. Right. The Court can simply carry on with just eight Justices. But without
Scalia, all the 5-4 Lib decisions simply become 5-3 Lib decisions, while all the 5-4 Con decisions become 4-4 ties, meaning that the lower court ruling stands. Scalia is taking the conservative cause with him to his grave.
