My Wooden Fence in Fairfax County - No HOA

I have a wooden fence on both sides of my backyard. It runs the entire length on each side, about 75 feet long. Their is no HOA in our subdivision of single family homes. Am I responsible for the upkeep of the fence on both sides.

I've heard various stories that I might not be responsible on the left side?

Fences are usually placed 6 to 12 inches inside your property line. If you want said fence to last, perform maintenance on both sides. Don’t be a fucking carpetbagger. You never know when you might need a neighbors assistance.

I have done maintenance on the fence for many many years. I have never been reimbursed for any repairs or asked for it. It was just a question. I believe it is considered a "shared fence." Neighbors are on both both sides.

With a shared fence, what if new neighbors move in and ask to replace it and split the cost with me, and I refuse?

If the posts are on your side, it's yours. If you denied they can't do anything, they can tear down the fence if it's theirs or build a new one alongside if you owned it.

Put that fence on your property line within a few inches with a land survey so your fence is on your side by about 2 or 3 solid inches including any posts in the ground

The land on the neighbors side is theirs by right of adverse possession after 15 or 16 years check with a lawyer for the facts of the case

Who preformes fence maintenance in anothers yard ? ON your side yes If its on open land that a different case

If the fence is within your property line and its your fence you can replace it as long as the new fence is on the same line. If its your neighbors fence because it was put over on their side too far after 16 years Then you have to put another fence up right along it unless you and neighbor can come to an agreement .

My neighbor wanted a 6 foot fence along the existing 4 ft on the back of my yard I allowed him to replace the 4 ft fence with the fence poles in the same spots the fence along the same line and now its 6 ft. We take care of our sides of the yard he owns the land on ne side and I the other .

Had this neighbor years ago that put up a fence, but it was over the property line on 3 sides. Not much, just about 6 inches.

He put the post side outside, so we had to look and the shitty side.

3 weeks after the fence was finished I called the county about the violation, and he had to remove the fence.

Too fucking funny to watch him pull out those concreted posts.

Jesus, is everyone on this site a fucking idiot? I don't think anyone answered your question, and most that tried were wrong. If you live in a typical subdivision where there are houses on 3 sides of you with fences in the middle on the shared property lines, then you have what is known as a good neighbor fence. Maintenance and replacement costs are supposed to be shared equally by by both owners. Unfortunately some neighbors are assholes (like a lot of posters here) and will refuse to share in the cost. There's really nothing you can do in that case short of taking them to small claims court. It becomes a real problem when the entire fence needs replacing and you have to end up dealing with 3 different neighbors to replace it.

In reality no one does that, maybe in a newer HOA subdivision that already came with fences? If my neighbor wants a fence, he can pay to build or repair it. When I want a fence I don't bother my neighbors asking them to chip in. I wanted the fence, I put it up, I'll maintain all all of it if need be. All the homes I have bought or built fences on clearly had them within the surveyed lines and were 100% owned by one side, not shared.

I live in a SFH with fence along both sides and along the back, all three were put up by the neighbors. No one ever asked me to share the cost (which I would NOT have done) and in fact, the last neighbor to put up a fence came over and asked me if I minded if she did.


If my neighbor has to put up a fence because he got a dog, how is that any of my problem? Should I also chip in for its food and vet bills?

That's different. I was clearly talking about subdivisions that had existing back and side yard fences put in by the builder. OP really didn't make it clear what his circumstances were, so now he has two reasonable answers to his question.

So called "good neighbor fences" can exist under neighborhood covenants or HOA rules. Otherwise they don't exist under Virginia law. Virginia law does recognize "common border fences". If a fence qualifies as a common border fence (and not just any fence will) it may be possible to force adjoining owners to contribute to the out of pocket costs of erecting and maintaining the fence.

Finally somebody with a brain gives a credible answer. Thank you. After some additional research I also consider it a good neighbor fence as you have stated. This fence has been installed for over 40 years and I have just maintained it over those years and have no problem with that. Maintenance should be shared, however I have "again" never asked for it.

I've replaced many of the 4 x 4 posts as well as all other boards.
Most people on this site just assume the worst on any new posts and attack just for kicks and grins.

if you have cattle and they destroy your neighbors property, not only do you not have to pay for damage, but you can force them to pay for fencing

It's been 7 years since we built a fence right on the property line. Two bad things have occurred. 1) We had to repair the fence and did not have the right to go onto the neighbor's property to do it. Luckily they are good folks and gave us permission but otherwise it would have been a trespass. 2) We trusted their survey which turned out to be off by 5 inches and that meant moving sections of fence. If we had it to do over again we would place the fence a foot back from the line. Not a big deal and it would have saved us a lot of trouble.
