3. Account and Card Activation

All Full Participants and Limited Participants must register an online account (“Account”) at nationals.com/access (“Program Website” or “Site”) to enroll in and participate in the Program and to access Program reward points (“Points”) and Red Carpet Rewards, as defined below.

For Full Participants, once eligibility is confirmed, the Full Participant of record will receive a card ("Card") for each seat included in his or her Membership or Plan, as applicable. Limited Participants will not receive Cards as part of this Program. Limited Participants shall, however, be able to access all Program functionality through the MLB.com ballpark application. Full Participants may also access all Program functionality through the MLB.com ballpark application. The Card will permit access to Nationals Park ("Ballpark") along with access to Points and Red Carpet Rewards. A Full Participant must register his or her Account at the Site prior to using the Card. A Full Participant must also activate the Card through his or her Account. Activation of the Card signifies acceptance of the Program Terms and Conditions. A Full Participant who has a Plan for the 2018 season and was enrolled as a NATS PLUS Member in a prior season will not receive new Card(s), but rather may use his/her previously issued Card(s) in connection with the Program, provided that he/she first visits the Program Website and enrolls in the Program by, among other things, accepting the Terms and Conditions. A Full Participant who is a first-time NATS PLUS Member will receive new Card(s) in connection with his/her Account. First-time NATS PLUS Members must visit the Program Website and enroll in the Program by, among other things, accepting the Program Terms and Conditions, in order to activate the new Card(s).

The Full Participant may also invite partners ("Partners") to join their Account. Partners must set up their own online accounts to participate in the Program and will receive personalized Cards. There is a limit to the number of Partners that can be added based upon the number of games included in a Full Participant’s Membership:

Number of games in Membership Maximum number of Partners

81+ games 8

41-80 games 4

20-40 games 2

Please follow the on-screen instructions to set up Full Participant and Partner Accounts. For the protection and the security of one's Account, login information and password should not be shared.

Cards issued for use during a game season shall be used for subsequent seasons, unless the Washington Nationals choose to issue new Cards. Cards may not be sold, bartered, traded, exchanged, given away or transferred. The Nationals are not responsible for the loss or theft of Cards, and for any transactions made using a Card. Replacement of a lost or stolen Card may be requested by mail, by email at Access@Nationals.com or at the Season Plan Holder Lounge at Nationals Park. There is a $10 replacement charge for lost or stolen Cards.

All Full Participants and Limited Participants must enroll in this Program to participate, including Full Participants who participated in the Access & Red Carpet Rewards Program in prior years. All Full Participants and Limited Participants must also provide a valid email address and telephone number and are responsible for keeping their contact information up-to-date. Full Participants, Limited Participants and Partners who enroll in the Program are referred to herein as "Participants".

4. Ballpark Access and Ticket License Terms

Full Participants and Partners may use their Cards to gain access to the Ballpark. Paper tickets will not be issued. However, such admission to the Ballpark is subject to the Ticket License Terms stated below. For purposes of this Section 4, all references to "ticket" and "ticketholder"/"holder" shall be read synonymously with "Card" and "Full Participant"/”Partner”, respectively, (as defined in these Terms and Conditions), and a Full Participant’s or Partner’s use of the Card to gain admission to the Ballpark constitutes acceptance of these terms.

Ticket License Terms

By use of this ticket, the ticketholder agrees that: (a) he or she shall not transmit or aid in transmitting any information about the game or related activities to which it grants admission, including, but not limited to, any account, description, picture, video, audio, reproduction or other information concerning the game or related activities (the "Game Information"); (b) the Club issuing the ticket is the exclusive owner of all copyrights and other proprietary rights in the game, related activities, and Game information; and (c) the participating Clubs, Major League Baseball Properties, Inc., Major League Baseball Enterprises, Inc., MLB Advanced Media, L.P. and each of their respective affiliates, licensees and agents shall have the perpetual and unrestricted right and license to use his or her name, image, likeness and/or voice in any broadcast, telecast, photograph, video and/or sound recording taken in connection with the game for all purposes and in all media known and unknown throughout the universe. Breach of any of the above will automatically terminate this license and may result in further legal action.

The license granted by this ticket may also be terminated by tendering to the holder the purchase price of the ticket. This ticket may not be used for commercial or trade purposes (including, but not limited to, contests, promotions or sweepstakes) without the express written consent of the Washington Nationals. The Washington Nationals reserve the right to change the date and/or start time without notice and without entitling the holder to a refund or exchange.

The use of foul or abusive language or obscene or threatening gestures, fighting, attempts to enter the field or to cause objects to enter the field, and irresponsible or underage consumption of alcoholic beverages, and any other action deemed dangerous, inappropriate, or in violation of the Guest Conduct Policy may result in the guest being ejected, refused initial admission, or arrested, without refund.

NOTICE: In the event of rain outs or other circumstances requiring the postponement of the game identified by the game number hereon, please refer to nationals.com/rainout for the policy applicable to the affected game and retain possession of this ticket as it may need to be presented at a later time.

WARNING: The holder assumes all risk, danger and injury incidental to the game of baseball or related activities, whether occurring before, during or after the actual playing of the game, including (but not limited to) the danger of being injured by thrown or batted balls or other objects, or by others in attendance; agrees that Major League Baseball, the participating Clubs, their respective owners, shareholders, partners, agents, players, officers, directors, contractors and employees are not liable for injuries or loss or damage of personal property resulting from such causes; and releases and holds harmless such persons and entities, regardless of whether any injury or loss is caused by any person's negligence or otherwise. Batted or thrown balls and bats and other objects can enter spectator areas with great force. Risk cannot be avoided if you attend games. If you would like to lessen your risk, the Washington Nationals will exchange your ticket for one in the UPPER DECK OR OTHER REMOTE AREA or, in the event of a sellout, will refund the ticket any time before the first pitch is thrown. The Washington Nationals may expand its use of netting; no refunds or exchanges will be issued.

No resale of a ticket is permitted via the Internet or any other interactive media, except through the Official Website of the Washington Nationals (www.nationals.com) or sites authorized by the Washington Nationals. This ticket must not be resold or offered for resale in a manner prohibited by any Federal, State or local law or regulation. Unlawful resale or attempted resale is grounds for revocation and cancellation without compensation. Tickets obtained from unauthorized sources may be lost, stolen, or counterfeit, and if so are void. It is unlawful to reproduce this ticket in any form.

5. eCASH, Bonus eCASH and eCASH Back

Full Participants and Partners may be able to use their Cards to make certain purchases in the Ballpark. If a Full Participant or Partner is eligible, then he or she can load cash ("eCASH") onto his or her Card using a valid credit or check card by accessing his or her Account through the Program Website or through the MLB.com ballpark application on his or her mobile device. Also, from the Full Participant’s or the Partner’s Account home page, the Full Participant or Partner can sign up for automatic debits from his or her designated credit or check card once the balance on his or her Card(s) falls below a certain amount ("Auto Reload"). Full Participants or Partners may also change their method(s) of payment, check their balance, and view their transaction history.

The Nationals, at its sole discretion, may, from time to time, offer promotional dollars ("Bonus eCASH" or “eCASH Back”). For purposes of this Program, eCASH Back is treated the same as Bonus eCASH. Bonus eCASH/eCASH Back can be used just like the eCASH Full Participants or Partners load onto their Cards, except that any Bonus eCASH/eCASH Back remaining on a Full Participant’s or Partner’s Card will expire on December 31st at 11:59 pm of each year.

Non-Bonus eCASH that a Full Participant or Partner load onto his or her Card does not expire and will roll over in his or her Account from year-to-year.

The total value on each Card, including eCASH, Bonus eCASH, and eCASH Back ("Card Balance") may not exceed $1,500 on any given calendar day. Any value in excess of this amount will be stored in one’s Account until the funds may be loaded onto his or her Card without exceeding the $1,500 cap.

· Eligibility and Activation Requirements

Each Full Participant and Partner should visit the Program Website, contact his or her account representative, or call 202-675-NATS to check his or her eligibility for eCASH and Bonus eCASH/eCASH Back.

Limited Participants are ineligible for eCASH, Bonus eCASH or eCASH back.

In order to add eCASH, a Full Participant or Partner must first log into and activate his or her Account. To be eligible to receive Bonus eCASH/eCASH Back, a Full Participant or Partner must load a minimum of $10, but no more than $200, of eCASH on the Card. The Auto Reload feature allows the Full Participant or Partner to automatically add a chosen value to his or her Card from his or her credit or check card whenever the Card Balance falls below a chosen minimum threshold.

The maximum Auto Reload amount is $200 in one transaction. Only two Auto Reloads are permitted within any given calendar day. A Full Participant or Partner may not manually load eCASH more than twice in any given calendar day and the total amount of eCASH manually loaded in any given calendar day cannot exceed $500.

· Receiving and Distributing Bonus eCASH and eCASH Back

From time to time, Bonus eCASH/eCASH Back may be awarded through specific promotions. Unless otherwise specified by the Washington Nationals, these awards may not be transferred to any other Account or Partner, but they may be distributed over some or all Cards within the Account to which the award was given.

In the event the Washington Nationals specifies that a particular award of Bonus eCASH/eCASH Back may be shared, the terms of this paragraph shall apply. Any Full Participant who is eligible to receive Bonus eCASH/eCASH Back that can be shared must specify how the Bonus eCASH/eCASH Back shall be distributed within that Account before the Bonus eCASH/eCASH Back is awarded. Bonus eCASH/eCASH Back may be distributed in one of the following ways: 1) 100% of Bonus eCASH/eCASH Back distributed to Full Participant's Account; or 2) Bonus eCASH/eCASH Back divided equally among all Partners currently active on Full Participant's Account. Once distribution preferences have been set by the Full Participant, Bonus eCASH/eCASH Back will be distributed to the Full Participant and/or Partners in accordance with the Full Participant's distribution preferences. The Full Participant and Partners may allocate dispersed Bonus eCASH/eCASH Back to Cards under the same Account that are in his or her control. If the Full Participant fails to specify distribution preference, Bonus eCASH/eCASH Back will be applied to the Full Participant's Account ONLY and may not be transferred to Partners. Bonus eCASH/eCASH Back may not be distributed across Accounts. Instructions on how to share Bonus eCASH/eCASH Back can be found on the Full Participant’s Account page. Once Bonus eCASH/eCASH Back is distributed and allocated to designated Cards, it may not be recalled, altered, or further transferred or shared by the Full Participant, the Partner, or the Nationals.

· Using eCASH, Bonus eCASH and eCASH Back

eCASH, Bonus eCASH, and eCASH Back may be used to make purchases at the majority of portable and fixed food and beverage concession stands and merchandise Team Stores at the Ballpark. Additional concession and vendor locations in the Ballpark may become eligible for eCASH, Bonus eCASH, and eCASH Back purchases in the future. eCASH, Bonus eCASH, and eCASH Back cannot be used to purchase, among other things, tickets or parking passes. To make a purchase, a Full Participant of Partner should simply present his or her Card to the cashier as he or she would any other form of payment. Upon purchase, the amount due will be deducted from your Card. Any Bonus eCASH/eCASH Back available on his or her Card will be applied before any eCASH is used.

In the event a Full Participant’s or Partner’s Card Balance will not cover the total amount of his or her purchase, a "split transaction" will occur and the Full Participant or Partner will need to present another form of payment at the time of purchase to cover the difference. A Full Participant or Partner may also sign up for auto reload on his or her Card, which allows the Full Participant or Partner to select a minimum threshold, and when the Card Balance is below the selected minimum threshold, the Card Balance will auto reload to the selected minimum threshold.

Use of the Card for purchases of goods or services is subject to a Full Participant's or Partner’s available Card Balance and to these Terms and Conditions. Full Participants and Partners should visit the Program Website or call 202-675-NATS to check their Card Balance.

· Discounts and eCASH Back

A Full Participant or Partner will receive a discount each time he or she purchases full- priced merchandise at participating merchandise Team Stores at the Ballpark. A Full Participant or Partner does not have to pay with eCASH, Bonus eCASH, or eCASH Back to get the discount, but must present his or her Card to the cashier to verify his or her Membership or Plan in order to receive it. The amount of the discount is as follows:

Full Season Members: 20%*

Suite Holder Members: 20%*

Half Season Members: 15%*

Partial Plan Holders: 5%*

*This discount cannot be combined with any other offer or discount and is only available at participating Team Stores at the Ballpark. The discount cannot be applied to the purchase of memorabilia, authenticated items, auction items, or customized jerseys. The discount is applied to the full retail price of the item(s) purchased before the application of any sales or other taxes.

Each time a Full Participant or Partner makes a purchase using eCASH, Bonus eCASH, or eCASH Back at a food and beverage concession stand at the Ballpark during a regular season game, he or she will receive a percentage of his or her purchase back in the form of eCASH Back as follows:

Full Season Members: 20%**

Suite Holder Members: 20%**

Half Season Members: 15%**

Partial Plan Holders: 5%**

**This Bonus eCASH/eCASH Back offer cannot be combined with any other offer or discount and is only available at participating food and beverage concession stands at the Ballpark where eCASH is accepted as a form of payment. No Bonus eCASH/eCASH Back will be awarded for the purchase of any catering for suites or other hospitality areas. The amount of Bonus eCASH/eCASH Back awarded is based on the regular retail price of the item(s) purchased, which price is inclusive of taxes. By way of example only, if a Full Season Member makes a $25 purchase using eCASH at a participating concession stand, he/she will be awarded $5 in Bonus eCASH/eCASH Back for making that purchase.

If only the Lerners would pay their manager as much as they pay their lawyers we'd be in the playoffs.

The Nats use these terms and conditions to prevent plan holders from gaming the system and to limit potential law suits against the team.

Businesses put boiler plate in contracts all the time. It's not news. They've been doing it for years.

You must have something wrong with your computer or something, because I saw this before I e-signed my contract. They have to show you that before they take your money, it's the law, even in DC, where the Nats and everyone else pays off the politicians. I don't know what plan you're on or what payment plan. I got half season and 3 payments, I saw this before I bought in in 2016, or a similar one. I've gotten a new one every year before the September sign up/re sign date.

If you reject the contract, they're supposed to give you your money back, if they've taken any, but there is a drop dead date in it, somewhere. Check your e-mails. You do have do keep up with these people and check your inbox all the time, or they will try to sleaze one past you.

The dummies always complain about how they are being set up to be ripped off because they are dumb enough to have been ripped off so many times before. You may believe that because I am top official of Nigerian Department of Contract Review, and do many dealings with American helpers of getting our trapped funds out of Nigeria and into freedom.
