Clerk at GameStop doesn't understand pricing laws

So, I took Huh, jr. in for a Skylander figure. It was marked originally at $15 and was now on sale for $9.95. When the clerk rang it up he said, "$15.98, please..."

And I said, "I'm sorry...this item is tagged at $9.95. Can you please adjust that?"

And the clerk said, "I'm sorry...the price rang up in the system as $15.98 inclusive of tax so, that's the price."

And I said, "Well, it's tagged $9.95 and there's 8 more of the same item over there tagged at the same price. Regardless, this one is tagged at $9.95 so, you legally have to honor that price. Is the manager available, please?"

And the clerk said, "I'm sorry sir, that is the price and I am the manager..."

I shrugged, walked out and bought it locally on EBay for $6 and had it delivered to me at the end of the day...

If the item was incorrectly marked, they are under no obligation to sell it to you at that price. An advertised or marked price on an item isn't legally an offer to sell the item at that price. It is a solicitation for offers to buy the item at that price. There are false advertising laws which prohibit businesses from intentionally advertising a product for a price they don't intend to sell it for. You might also have grounds to complain if they sell you something for a price different than the marked price without telling you. However you cannot force them to sell you the product at a certain price simply because it is marked with that price.

That is correct. Some retailers will honor the erroneous price tag as a form of customer good will. They are under no obligation legally to do so.

The truth is, many people change price tags to lower prices to scam the merchant. This is probably what you did too, isn't that right you little jerk?

Why would I change the tag, not disclose that and then waste everyone's time here with this? Christ...I got day laborers to go and "handle"...
