Small Claims Court for $400??

Hello,

My friend paid $400 (via check) to be part of an AAU basketball team. Things did not work out and the coach told him via text he would return the money but it has been 2 months now and he is ignoring his calls. What are his options to recoup the $400? Is court worth it? How long would it take and how much would it cost?

Court should be the last resort. Its expensive in time and to society. I always try to be persistent with the other party. Never loose your cool. Have all your supporting paperwork, which you will need if you do end up in court. Keep a log of all contact and communication of any type, and money spent. Always follow up any communication with an email or text as court's will accept these as evidence. If you have a concise contract, proof of payments made, and a rational demeanor, most times they will settle. Lastly, leverage is a great tool. Does this guy answer to anyone? Does he have contracts with local government? If he feels that larger interest are in jeopardy he will be inclined to pay you. Start freindly, progress to concern, move to disappointed, then to firm, and save adversarial for the last resort. Never loose your temper or good manners, it will diminish your position. Good luck

You will probably win the lawsuit, but then you will have to collect.

I'd recommend sending the guy a certified letter demanding refund. I'd also send a certified letter to AAU telling them what is going on.

If that doesn't work, then file the suit-but name AAU in the suit as well. Either they will pay to avoid the hassle (no lawyers in small claims court, so they will have to send a representative) or they will put pressure on the coach to pay up.

Fuck this is exactly what small claims court is designed for. Its been 60 days since the OP requested repayment of monies. how ong should he wait for the deadbeat to repay. how hard is it for the coach to stroke a check or send a paypal.

If the coach is ignoring phone calls. SC is the next step.

Cert letter cc coaches boss/organizational group. Then court. Mention a date in the letter you will proceed with legal remedies. Be glad its only 400 bucks.

Small claims are under $5000. Done it twice and won twice. The thing is if you have no written proof you are prob screwed. Plus actually collecting is tough. I literally went to his boss, showed him the court paperwork and he was cool enuf to do wage garnishment. Other than that it is hard to collect.
