He said he’d never heard of Fox News’s Greta Van Susteren prior to receiving an invitation to be on her show. When he was told that Van Susteren is a former Washington defense attorney, Hanover quipped that he’d reconsider his decision to appear. 'Oh [expletive], that means she’s going to ask me tough legal questions,' he said."

Police action on a Backpage Escort Ad

I recently answered a questions about solicitation and entrapment on a local legal board. I thought the question was interesting enough to repost on my blog:

(summary) I am a escort on Backpage. I have been posting online for months. My ad states that anyone that wants to meet me must send a pic and picture of their penis. Can a cop do this? Or do they try to avoid sending those types of pics since they are trying to be undercover?


A couple of interesting points.

First, you have to be careful how you ask your question. Essentially, you could just be asking for someone to help you break the law regarding solicitation for sex. That's a problem for everyone, including yourself. The most obvious answer is -- don't break the law. If the jurisdiction where you "practice" outlaws prostitution (or advertising online), don't do it.

Now, having said that, your question about what the police may or may not do in an undercover operation can be answered without directly advising you on how to break the law. The government is free to pose and act (even in an illegal manner) in order to "catch" someone in the process of breaking the law. Examples include "paying" for drugs, and setting up child-sex meetings by posing as a child online. These are common examples most people would be familiar with. However, other more subtle examples exist. Take for instance the "informant" that infiltrates a conspiracy to sell cigarettes across state lines without paying taxes, or a "runner" who delivers messages between smugglers. You get the idea. In summary, a police detective or officer could absolutely pose or send you pictures in order to get you to incriminate yourself.

What the officer cannot do is initiate the illegal activity him/herself. For example, the police officer could not approach you and say, "hey, you wanna have sex for money?" That's called entrapment. While there are some exceptions to this (for ongoing investigations where an underlying warrant or probable cause already exists for the conduct), as a general rule, the cop can only respond to what you do, not initiate.

I have a legal question. I am a piano playing cowboy from Richmond, VA. Like you, I am a Christian. Also, like you, I don't know what I am talking about most of the time. Here is my problem. very time I post something on my Tumblr account about the homos, Obama, my invisible girlfriend, my future wife, uppity colored people, or colored people in general, people on a Northern Virginia website make fun of me.

I am a famous songwriter from Richmond, VA. I also dance around in Statue of Liberty or cow costumes for a living. I played a sleeping guy on a battlefield in a major motion picture once. I don't need this bad PR fro this website; it may effect getting me a country music singing, God Fearing, Christian, Mamma's Family loving, wife some day.

I know this question isn't as interesting for you as dick pics over the internet questions are, but, can I sue a website for allowing jealous people to make fun of me?

Breaking News! After meeting Mr. Hanover at least three times, the accused, Daron Wint, fired Sean Hanover as his private attorney, and went back to his original DC public defenders for representation, according to today's court records.

Thank God this "Legal Feeble" Hanover wasn't given more opportunities to embarrass himself further in this high profile case.

It is a win-win for all, except for Sean Hanover, who embarrassed himself more over the past two weeks than he embarrassed himself blogging about emailing penis pictures in regards to the laws of entrapment on his website blog.

Pub. Defender ... Some aren't that bad and some cannot even understand and piece together all the details presented to them, so they can provide a viable defense.

A lot of them settle and then plea bargain, but Wint is maintaining his innocence, saying that he was "set up".

I'd love to be able to be there to see the circus it will be in court with the Pub. Defender.
For now, investigators are trying to get more warrants on evidence so they can serve more arrest warrants.

It seems others were involved. I really hope those others are brought to justice as well.
It is such an awful thing, to hear about the torture and murder, esp. of a 10 year old just starting out in life. Too sad.

DC would never give such a high profile case to a PD who is not capable of providing a top notch defense. It is not in their best interest to have a mistrial because of incompetent representation. As a matter of fact, the case was given to two experienced PD's with homicide cases experience . One is a long serving supervisor in the PD office.

That being said, did anyone else hear Mr. Hanover say something like his client "didn't intend to hurt anybody"?

"At an impromptu news conference after today’s hearing, [Sean] Hanover revealed his theory that Wint had been “set up” as the fall guy by alleged co-conspirators in the case. He would not comment on who he believed the other co-conspirators to be.

Hanover was asked if Wint had ever expressed any sympathy for the victims.

Wint "was heartbroken like everybody else at their death. And I can assure you he never intended or wanted anybody -- them or anyone else–to be harmed," Hanover said.

When reporters asked if that statement was an ADMISSION that Wint did, in fact, have something to do with the murders, Hanover said, “he has never intended anyone any harm.”

Nice, son. When asked a specific question, answer with a specific statement, then, clarify by making a general or over-all statement.

Did you see Sean Hanover's presser this afternoon? He stutters when he is uncomfortable answering a question. Not a good trait for a defense attorney. He also said "less than one hundred," instead of "Fewer than..."

If you want to see clown lawyers, look at Connell and Nancy Fry Loftus. Connell Loftus was an equity partner in Mann Bracken, one of the biggest failures in collection law history. It was forced out of business, and Loftus has bounced from one job to another.

Nancy Fry Loftus was a Fairfax assistant county attorney, but her political ambitions put a stop to that. She decided to run for Fairfax City Council, and won. So, she ended up trading an $80,000/year job for an $8,000/year job. It looks like Connell needs to figure out a way to make some money.

Hanover may stutter and have less than perfect grammar, but he was NEVER involved in a scam operation like Mann Bracken. Mann Bracken used to lie to the Better Business Bureau, claiming they'd never written to people. When confronted with their own correspondence, all they could do was blame an associate attorney, Chris Diwan. Diwan also entered into a bizarre dispute with Fairfax-based "Corporate 180" a dispute resolution firm operated by Andrew Flint and staffed by husband and wife real estate brokers, Peter and Helen Evans. What a sideshow!

How about we compare Hanover to the Public Defenders now back on the case? That shoud be fair, correct? As WUSA's Bruce leshan said last night; "the new attoneys for Daron Wint, they are not talking. But, it was hard to get his now fired former attorney (Sean Hanover), to stop."

Mann Bracken was bad news.

I used to have neighbors-immigrants from somewhere up north of India. Mann Bracken used to call her cell phone all the time. They would not stop. They used up all of her minutes. She had some kind of deal for a ride to work, when her minutes got used up, she had to walk.

She got a foot infection. She had friend drive her to Mann Bracken, I think they were in Gaithersburg. She would not leave. Mann Bracken called the police. When the saw all of the calls and the bleeding feet they suggested Mann Bracken do something. They took her number out of the dialer and gave her $1,000.

How do I know all of this? One evening they called ME looking for HER. I went over and she told me the story. I called them back and let them have it. They took her number out but not her name and address, which she gave them when she went there.

I told her I was going to sue them for deceptive practices and suggest she do something along the same lines. Each of us got a check for $500 with a letter from none other than Connell Loftus. He seems a million times worse than this Hanover person, at least he is trying to make an honest living. Loftus seems to be a hustler, giving lawyers everywhere a BAD NAME.
