Jury reaches verdict in Fairfax road rage killing

WASHINGTON -- A jury found Librado Cena guilty of misdemeanor assault in a fatal road rage incident with complicated circumstances.

On April 16 last year, Cena followed a gold minivan into a Best Buy parking lot to confront its driver, William O'Brien, who Cena said had been honking at him.

A 40-second altercation followed and both men struck each other in some way. Cena says O'Brien lashed out first. At some point, Cena hit O'Brien in the head.

When it was over, both men seemed fine and walked away. But 10 days later, O'Brien was dead.

O'Brien's death was ruled a homicide, but Cena wasn't charged with murder. He was found guilty of misdemeanor assault in Fairfax County Circuit Court on Tuesday and not guilty of battery.

O'Brien took Pradaxa, an anti-stroke medication that prevents blood from clotting. Cena's blow caused O'Brien's brain to bleed, and it continued unabated, never clotting.

The defense says if O'Brien hadn't been on Pradaxa, he wouldn't have died.

The jury heard the 911 call during Monday's trial, which O'Brien placed from his home about an hour after the altercation. He complained of a headache unlike any he had ever had before.

Cena's police questioning was also played for the jury, during which he said he wanted to yell at O'Brien for incessantly honking at him on the road. He also said O'Brien kicked and punched him first, before the fatal blow.

There is video of the altercation from Best Buy's surveillance cameras, but it's taken from such a distance that it's difficult to tell from the footage exactly what happened.

On Monday, Cena told the court he regretted following 63-year-old O'Brien. If he hadn't, Cena said, "None of this would've happened. He wouldn't be dead. I wouldn't be here."

Cena will be sentenced on Wednesday. He faces up to $2,500 in fines and 12 mos. in prison. He could get either or both.

Not surprising. The prosecutor didn't even come close to proving Cena hit first, so battery is right out. Cena's admission of his aggressive behavior was apparently regarded as sufficient to be a threat, which is assault.

Except that what he did was not murder, or manslaughter, or even malicious wounding. It wasn't legally any of those, and it wasn't, in fact, any of those. At least as far as we can tell. So unless you have a witness who saw the whole thing (there was one, the police could never find her), or a video other than the one above, then you're pretty much talking making stuff up.

Heard it on the radio this morning before 6am. To clarify I believe they were quoting something either one of the investigators said or someone in the court case. But I remember it well.

I do believe he was looking to get even though. Not sure if they necessarily means a fight. Personally, if this was my family I would sue the pants off of him in Civil Court.

What makes Mr. Cena less responsible for kiling Mr. O'Brien is that Mr. O'Brien *MAY* have initiated a physical battery first. We do not know, either to a legal standard or a moral standard. In short, you can't tell if Mr. Cena wanted a fight or not from the evidence. And you can't tell if Mr. Cena started the fight or not. Without evidence that he either wanted or actually did start a fight, it's not reasonable to conclude he was responsible for Mr. O'Brien's tragic death. It's just not logical. You can't conclude something without evidence to believe it, and it's just not there.

Which is why the jury found him not guilty of physically battering Mr. O'Brien. And I was there from the very beginning of the trial, and saw the motions the defense made to exclude evidence; they saw everything the prosecution wanted them to see. The only things excluded would have helped the defense, such the witness who was some of the altarcation, Mr. Huan's, who said in his *opinion* (take it for what it's worth) that Mr. O'Brien started the fight. Well, technically they heard it, as part of Detective Boone's testimony, but were instructed not to consider that aspect of it.

Your missing the point. It doesn't matter who started it. Just who finished it. The common theory is that he didn't mean to kill him and who could have known he was on blood thinners, right?

There is a concept in the law of clean hands. If you don't have clean hands, then you are invariably responsible for what happens as a result of your "unclean" activity. Then you take your victims as you find them, with all of their inherent "faults".

You rob an old lady by grabbing her purse and run. She loses balance, falls and breaks her hip. She then dies of a hospital induced staff infection, you can theoretically (and it happens in practice) be held directly responsible for her death.

I am talking about generics here, not the specifics of the case you have been attending. I am merely saying he got what he deserved, because he killed someone accident or not.

What happens once he gets out of jail? I don't think his church will welcome him back with open arms. Even if they do, the congregation probably will not. Certainly not the public. I think his life is finished here (either in part or entirely) in this area.

Heh. No. Not only do I not fight unless someone is an obvious and imminent threat to my or my family's safety (because anything else is illegal and immoral), but I could only take off one day of work to observe the trial. I wasn't there yesterday and can't be there today.

C'mon Kardinal, you can take him. Just make sure to be 500 yards away from the security camera so they can't tell which blur is you. LOL

You're funny. No, I probably couldn't take him. I'm a bit bigger, as I'm over six feet, but I'm not a very experienced fighter because I don't fight. I'm not reluctant about getting caught; I'm reluctant because it's wrong to fight unless your bodily health is threatened. And while he may be a better fighter than I, I don't think he's an imminent threat to my health or well being. He's just a guy spouting nonsense on the Internet. If I felt threatened by those people, I'd be a very very scared man indeed. :)
