Expungement of record

Can anyone give more information about how expungement works?

My case was dismissed as I was arrested for no reason. I got my record expunged, but the arrest still shows up even though the expungement has been filed and I received confirmation of it.

Are you sure the case just wasn't dismissed? That arrest record isn't official or anything that's why that online case info has a disclaimer on it. I believe if a company were to do an official background and the arrest record would prolly not show up since you said it was expunged.

Well, i had to go to pre-trial but it was dismissed and the dismissal was part of the argument to file the expungement. I received confirmation that the record was expunged. I hate to spend more money, but I believe you are right that it would not show up in an official background

I used a lawyer (expensive) got everything filed with fingerprints and everything, but the arrest record still shows up online

This site isn't connected with the police or the courts. Your expungement wouldn't do anything here, it is a privately-collected database. So everything may have indeed gone correctly for you as far as official court and police records.

This site isn't connected with the police or the courts. Your expungement wouldn't do anything here, it is a privately-collected database. So everything may have indeed gone correctly for you as far as official court and police records.

Fairfax Resident, you seem to be in the same dilemma as I - I too had an arrest based on false charges, case was dismissed and expungement granted. However, my arrest history is still available on FFUG. It is a source of great misery and humiliation for me - such data should be removed from this list as it has been from all other sources. Have you found a way to do it? Anyone?

Yes, it can be done. There's a Virginia law against publishing expunged material.

You file a motion to get it removed, or the owner of FFX-U is penalized.

I've done it, know others that have. I used the Sris law firm. Cary W. rarely if ever appears in court, you get the order against the FFX-U hosting company and the upstream provider. In other words, if it is not taken down, the site goes dark.

you have to wait for a period. years.

then ask the clerk for a motion to expunge form, fill it out, wait for response

you don't have "to serve it" because, i guess, the comlaintant is the police and or courts and your giving it to them directly and get a stamp. (i assume)

if you were innocent you many NOT want to expunge.

reason being is if you get legally harassed by legal people you can't show you were if you allowed them to delete all the evidence they falsely prosecuted you multiple times

after longer period the records are forgotten. because it costs money to keep them all on file.

however gov is stupid these days.

they keep records of failed prosecutions and use it against people in the media

if you get it expunged doesn't mean some computer somewhere hasn't stored it (ie, like lexus nexus) and won't show "code charges" to a prospective employer - even ones that failed in court

there isn't much government hasn't fucked up, in other words
