So I just moved to fairfax been up here about 4 days and had to go out to falls church for a job interview and on the way back I toke the exit at monument drive in fairfax and got pulled over for using hov. I know signs say 2 people only but I honestly thought since its a exit and even my navi told me to get off there since I live by goverment center. It was ok The officer told me know gave me the ticket and basically said welcome to va. Is there a way to dispute this cause I honestly didnt know about it. I figured its a normal highway exit that is just to the left of a hov, I had no idea.

Welcome to NOVA. You can make up all the excuses and alibis you want. They dont care what you "thought" or what your navi told you. Youre gonna pay it. So either waste a bunch of time fighting it or just pay it and move on.

Wow like I even have my paperwork showing I just moved here. My car license etc isn't even va yet so why no warning.

I moved here from a place that had no such things as HOV or hot lanes. I never once meandered into the HOV when the restrictions were active because I read the signs. Your navigation is designed to help you; but you should plan and know your route ahead of time. If the sign says don't and the nav says do, follow the signs. Garmin won't give you a ticket for your fuck up, but the cops will. And here in VA, warnings seem as rare as an albino dwarf. Take your first ticket as the warning (there were more than enough signs for you to have seen) because the fines for those jokers get unbelievably high.

Yep, I got an HOV ticket once while in Old Towne Alexandria driving South. I wasn't in the HOV lane until I had to get into it because I nneded to make a left hand turn. I saw an opening in the lane so I got in it about a traffic light before the turn came up. Cop further up on the sidewalk gestured me to pull over. He asked me if I knew why he pulled me over. I told him probably because I got into the HOV lane. He said, correct. I told him I needed to make a left hand turn so that's why I got into the lane. He said I got in it too soon at which point I said I got in it because the turn was coming up and I saw an opening which might not have been there if I waited to the last second to try to get into the lane and make the turn. His reply, sorry, sign here, you can pay by mail or argue it in court. I went the court route and told the judge the same thing and he said, sorry but you were in the lane too soon. Really??? I got in the lane about a traffic light before the turn because I saw an opening but they want me to wait until the last second to get into the lane at which point there might not be an opening so now I just sit there in the middle lane with my blinker waiting for an opening and backing up traffic?????

LESSON LEARNED FROM THIS EVENT........YOU ARE GUILTY, REGARDLESS!!!! COMMON SENSE DOES NOT PLAY IN THIS AREA!!!

If you got a ticket for getting int the HOV lane one and a half blocks before your turn, I am guessing you actually got that ticket in Alexandria because neither the cop nor the judge BELIEVED you when you said you intended to turn at the next block.

This is one problem with Alexandria's HOV setup. It relies heavily on what the officer believes the non-HOV driver's intent was in moving into the HOV lane. Did you get over early because you forgot that the upcoming street was one way the wrong way? Did you get over early because you thought your turn was coming up, when it was actually one block further? Did you get over early because it looked like there was a break in the traffic that would let you over? Or did you get over early because you saw HOV lanes were moving and non-HOV were not, and you thought you would be turning before you got caught? Or did you only decide to turn when you realized that the police were enforcing HOV that day?

Guess you really didn't pay too much attention on what I wrote. Anyway and again, I got over into the HOV lane about a traffic light before the turn. I knew where my turn was. When I got into the HOV lane it was at the light where the street(upcoming) was going one-way to the right. The next light was where I needed to make my left turn so this is just one block from my turn. From the cops and judges viewpoint I guess this is considered too early. I clearly told both the cop and judge I got in HOV because I saw an opening and I needed to make the left turn that was coming up. I GOT IN BECAUSE I WASN'T GOING TO BE ONE OF THE FUCK TARDS IN THIS AREA THAT WILL BLOCK TRAFFIC BECAUSE OTHER DRIVERS WON'T LET ME IN OR HELL BETTER YET, TURN LEFT FROM THE MIDDLE LANE!!!

I rarely use HOV but had a full car and used it from DC the other day. I have to admit the signs are confusing. Not impossible to understand but at 55mph they are not clear from the beginning and the clearest signs are right at the exits.

I kept seeing single drivers in the HOV with me on 395 HOV just into VA and I though they were screwed but there were two exits with signs (at the last moment) stating non-HOV must exit here. You really have to plan/know the exits before you get in your car because one slip and you are in for a nasty ticket.

That said bet OP wont ever get another one at that exit :)

No. You are the one not paying attention. If the officer BELIEVES you were using the HOV lane in order to bypass stopped or slow traffic in the regular lanes HE WILL TICKET YOU, regardless of the story you tell.

You are assuming that because the officer and the judge said you got over too early, that is why you were ticketted. I am suggesting they were just humoring you.

Welcome to Virginia. Driving here sucks...I prefer the public transit system...which could also be better, but still sucks less than driving. Just wait till the gouge you at mandatory "safety" check time.

Well the officer could of easily just followed me and I would have showed him where I was going. You said if the officer "BELIEVES" to me that means the same thing as "ASSUMES". He had no proof so poof I get ticketed. I could of showed him where I was going but that would be useless to try to explain since common sense again does not play in the law and justice. Next time I should just turn from the middle lane. Hell it may be cheaper to do that than get the HOV fine. I obey the traffic laws and would not hesitate to do it again. If I need to make a turn and it requires me to be in the HOV lane to do then I have no choice. Again, I wasn't driving in the HOV lane but block before the turn because there was an opening. Sad that the police in this area just can't use a few more brain cells to figure some things out. Oh well, lesson learned on how the mentality of law enforcement and judicial figures use "reasoning" in this area.

The original poster is likely NOT being truthful about his lack of HOV knowledge. How many people living in Northern Virginia would not know or understand HOV-2 before they know to come to Fairfax Underground to gripe about their life experience....?

Anyway -- just go to court and plead no lo contendere (no contest), provide a brief explanation to the judge, and see what happens. Many times things (charges, fines, points) are reduced somewhat -- IF you have a clean driving record for the past 5 years.
