Woman living with "friend" lost support

Saw a posting about this last year. Two lesbians living together, who apprently say they are not lesbians, have been living well because one of them was screwing her ex-husaband by getting spousal support. Husband filed for termination and won in the trial court in Fairfax.

The lesbian was not happy and appealed the decision to the Appellate Court. The ex-husband represented himself, prepared a brief, argued in front of the Appellate Court and won.

Holy cow, the legal system actually worked, and the angry, men hating, incredibly opinionated, and self serving lesbians, and for that matter the gay community as a whole doesn't like it.

This guy is my idol. He was getting abused financially by a lesbian, didn't like it, and did something about it. Even presented oral arguments in front of the Court of Appeals of Virginia. That takes balls. It is about time someone did something about men getting screwed financially by their entitlement seeking ex-wives. Go get a job, move on with your lesbian lover and accept the fact there is a cost to being gay. Link to opinion below.

Virginia Code 20-109 (A) says: A. Upon petition of either party the court may increase, decrease, or terminate the amount or duration of any spousal support and maintenance that may thereafter accrue, whether previously or hereafter awarded, as the circumstances may make proper. Upon order of the court based upon clear and convincing evidence that the spouse receiving support has been habitually cohabiting with another person in a relationship analogous to a marriage for one year or more commencing on or after July 1, 1997, the court shall terminate spousal support and maintenance unless (i) otherwise provided by stipulation or contract or (ii) the spouse receiving support proves by a preponderance of the evidence that termination of such support would be unconscionable. The provisions of this subsection shall apply to all orders and decrees for spousal support, regardless of the date of the suit for initial setting of support, the date of entry of any such order or decree, or the date of any petition for modification of support.


Precedent case law from the Virginia Court of Appeals has described four factors for judges to take into consideration to assist them in deciding if a relationship is one that is analogous to marriage:

1. Living under the same roof for at least a year (commencing on or after July 1, 1997)

2. Intimate or romantic involvement. (Intimacy does not require sexual intimacy.)

3. Provision of financial support (support going either way or both ways)

4. Other evidence of duration, permanency, and other indications of a marriage-like relationship.

Pellegrin v. Pellegrin, 31 Va. App. 753 (2000)

Also, in Pellegrin, the court of appeals says that no single factor is determinative and the tial judge can assign any weight s/he wants to any and/or all factors.

That didn't seem to come up in any of these arguments. Doesn't look like the husband was ever charged with anything. Looks to me like another woman in a divorce making accusations, which end up being untrue.
