You all may remember this story below!! They are all free and the case got dismissed yesterday for Lack of Evidence... You can steal almost a million dollars in Fairfax County and get away with it! Oh well the American justice system failed... I feel sorry for the victims.

Police make arrests in string of burglaries targeting a particular ethnic group

AP Police finally cracked a prolific burglary ring that funneled gold and family heirlooms out of Fairfax and Loudoun counties.

Investigators believe the suspects may be responsible for 20 or more burglaries, and a discovery made at the time of their arrest explains why it was so hard to catch them: they were tuning in to police scanners to avoid the cops.

For weeks, cops in Northern Virginia have been baffled by the burglars' M.O.: they strike in the middle of the day, breaking into homes and stealing gold-- lots of gold-- while leaving other jewelry and pricy electronics behind. What had many even more concerned is how these thieves seemed to be picking their victims: nearly all of those targeted were of South Asian descent.

"These three suspects were targeting a particular community-- the South Asian community," Fairfax Officer Bud Walker said; "that's unacceptable in Fairfax County."

Victims say the manner in which the alleged burglars picked their victim means they should face more serious charges.

"They were picking and choosing Indian Americans and targeting them, and so we feel they should be charged with a hate crime," burglary victim Raman Kumar said.

The break in the case came yesterday, when investigators pulled over an SUV, and realized that the trio inside matched the description of the serial burglar suspects.

Francisco Gray, Dagoberto Soto-Ramirez, and his wife Melinda Soto each face nine felony charges, including burglary and grand larceny.

"When we served a search warrant on their vehicle, we found materials inside the vehicle that suggested they were going to commit a burglary," Walker said.

That evidence included a laptop, GPS, and that scanner, where the suspects could listen to police communications, and figure out where officers were.

Police say their investigation is just beginning, and they believe that many more charges could follow. The trio is now suspected in crimes that span several jurisdictions, and at least two states.

My reading comprehension is pretty good, but I still haven't figured this thread out.

The nolle pros tells little, there could be a refile, new or amended charge coming.I wouldn't consider anyone free until you hear it from someone on Chain Bridge Road.


The Hate Crime angle confuses me more.

u ppl dont watch enuf cop shows, it said loudoun and fairfax, i bet the fairfax folks dropped their charges so these guys would cooperate w/ loudoun, theres no way it would just be dismissed like ur saying. Ive been in traffic court when an ofc requests nul pros, its like they decide not to go forward cause they made some deal

The reason these cases were nolle prosse[d] is because these three are probably part of an east coast ring out of New York and have either turned state's evidence or are now working for the feds.

Stealing from a particular ethnicity because people in that ethnicity happen to have a lot of gold isn't a hate crime. That's picking your target to maximize your profit. You have to prove that there is hate, or are hateful actions, for something to be a hate crime. If they stole from a particular ethnicity and then beat the shit out of them, that would be a hate crime.

By that same logic, is it a hate crime for Eastern Motors to target blacks and hispanics in their commercials? No. It's business.

And if the only evidence was a police scanner, GPS, and three people who matched the description, it's no wonder the case was dismissed. It isn't illegal to have scanners or GPS devices, nor is it illegal to drive an SUV with two passengers. If that is all of the evidence they could find, that case wasn't even worth prosecuting.

If they were completely exonerated the case would have been dismissed. Nolle Prosequi means the state has a year to refile charges. This translates into either there was a lack of evidence (so the judge is giving the DA a year to get his shit together) or they have turned state's evidence and are 'rolling' on the ring they belong to.

Nolle Prosequi doesn't mean they have a year to refile. It means "to be unwilling to prosecute"

It can be declared if the charges cannot be proved, evidence has demonstrated innocence or a flaw in the prosecution's argument, or in cases where the accused person has died.

They may have a year to refile charges, but you don't just bust out Nolle Prosequi without cause, especially since it means the accused can legally leave the state/country given that there are no longer any charges against them.

It's possible they did turn states evidence, or it may be that the evidence is so thin that it wouldn't be enough to convict.

I wasn't trying to infer that was the literal meaning; I am aware it means [choose to] will not prosecute. What I was trying to get across was that they have up to a year to refile.

Then why wasn't it just dismissed? A: Because they want to reserve the right to refile once further evidence comes to light or the defendants turned state's evidence.

Once again, if that was the case, then why wasn't it just simply dismissed? When people turn state they get the Nolle Prosequi, so in case the defendant fucks up or doesn't want to follow through, the DA can come back and prosecute. Once again, it's either that, or the state's case was weak and they needed more time to make a case that sticks.

You're assuming that someone in the prosecution didn't fuck up. Perhaps they filed too early.

In any case, I'm not saying that they might not refile at a later date, but I'd love to see the odds of that actually happening and how successful it is when it does happen.

When a case is up for trial and evidence that exhonorates the accused is either found to prove the defendants innocence or raise "a reasonable doubt" they will use this method because it allows future refiling for one year if more evidence is found. I believe the dismissal route actually leaves the police open to lawsuits for wrongfull accusations and false arrest.

I wonder if they used the scanner website that's so popular here. This is why police should use encryption.

There a lot of immigrants who tend to keep cash and other stuff in their houses because they don't trust banks. I wouldn't be surprised if someone went around stealing cash from immigrants.

The guy who said it should be treated as a hate crime is of Indian origin based on his name.

It is no hate crime by any stretch of the imagination. The thieves target Indian homes because they are typically into keeping gold jewelery at their homes. So they go where the gold is to be found.

It is nonsensical to suggest that this is a hate crime.

Four more New Yorkers have been arrested in connection with a burglary ring that targeted homes in Fairfax and Loudoun counties and stole only gold, in addition to three who were arrested in Centreville in November, police said Friday.

On Wednesday, at a preliminary hearing for the first three defendants, Fairfax General District Court Judge Ian M. O'Flaherty dismissed 10 counts of burglary and grand larceny against Dagoberto Soto-Ramirez, his wife, Melinda M. Soto, and Francisco Gray. Fairfax prosecutors withdrew an 11th charge against all three, and a 12th charge of burglary is pending. Fairfax Chief Deputy Commonwealth's Attorney Ian M. Rodway said O'Flaherty had excluded some of the commonwealth's evidence, and that prosecutors were considering seeking indictments of the dismissed charges. Soto-Ramirez and Gray also face six counts of burglary and grand larceny in Loudoun, and all three remain jailed.

Fairfax police said they also obtained warrants for conspiracy to commit grand larceny against Jonathan A. Brunett, 25; Nubiela Gaviria, 50; and Consuelo M. Rojas, 59, all of Queens, N.Y., and Karen Echevarria, 28, from the Bronx. All four are in custody in New York, Fairfax Officer Tawny Wright said. Rodway said they are alleged to be involved in "the overall planning" of the burglaries, in which electronics and other valuables often were left behind while items containing gold were swiped from South Asian homeowners.

Sounds like the police couldn't show probable cause for searching their van without a warrant and all the evidence was dismissed. No evidence = no case. Now the police are scrambling to get search warrants for these people's residences.

Another reminder as to why you should never consent to a search of your vehicle, even if you're not a criminal. You never know what the police might 'find'.
