Towing Problem

I left for a trip June 1st, got back June 12th. Returned to a notice on my car that i needed to pay a 75$ ticket. The ticket needed to be payed by June 10th in order for the car not to be towed. This is a Home Owners Association ticket, not FFXPD.

The ticket is for something stupid, but i wont get into it.

I just tired calling the help line at HOA and not only does the voice mail not work, the emergency number for things such as a property on fire ect. just rings back to voice mail. I did send a email, so hopefully that will work.

I don't even care about paying the ticket, i just don't want my car towed, and because it's private property FFX Police can't do anything about it. Non-Emergency was actually pretty helpful.

So I'm kinda stuck, I can't talk to the owner of the property who is threatening to tow me, and FFX won't prevent it from being towed.

I can prove i was on a trip
I can prove when the notice was put on my car

IF my car is towed, what are my chances of winning in court?

Also 10 days to pay a ticket is absolutely crazy.

Sadly because it is private property the owner has the right to do that, and you will not have a good chance of winning this fight in court.

The only bit of help I can see in that code I've linked you to is: "The ordinance shall require the owners of private property which is normally open to the public for parking to post or cause to be posted signs warning that vehicles left on the property for more than seventy-two hours will be towed or removed at their owners' expense." (§ 46.2-1215) Were there any warning signs present? If not, you might have a few toes to stand on in court, but not quite a leg.

I personally hate HOA's and everything they stand for. It's a bunch of old people on a power trip, but there's nothing we can do about it. If they own the parking spots / parking lot, then it's private property. The police can't help you, so you have to deal with this through your HOA.

That sucks, no warning signs, but this is my assigned parking space for the condo I own. I guess the HOA could claim that the notice i got on my car was the warning. Even if i didn't receive that notice.

The more i read about this, it seems HOA's can pretty much do whatever they want, and the homeowner has no laws protecting them.

I own a home at the complex, so it's not like my car doesn't belong in it's assigned spot.

Luckily we have a board meeting coming up next week.

Talk to your neighbor in the spot next to you. Tell him that just for a little while you need to park real snug next to his car. When you do park real close to his car, cut your stearing wheel so that if you were to get towed out of your spot the front of your car would hit his. Sometimes this will make a tow truck driver think twice about taking your car with the risk of damaging the one next to it (so I've heard).

Why not park it in some kind of guest parking somewhere within walking distance until you can pay the ticket on Monday? The tow driver would be told to grab the car with your plate in your assigned spot. If it isn't there it doesn't get towed.

According to the HOA is was relocated 50 feet to the other side of the parking lot for "Parking Lot Cleaning" I did not get the noticed it would be happening two days in a row, just on one day, so my car was left the 2nd day.. Regardless, i don't care about the $75.00, but how they go about collecting the money is crazy.

I will be paying on monday, but i think I'm safe, because i was calling them acting like someone had parked in my space, and needed them towed.(Just so i could talk to someone) I couldn't get in touch with Anyone, so i doubt they will do anything until monday.

by the time monday comes it will be the 15th... the car was supposed to be towed on the tenth.

the guy makes frantic emergency calls and they go unanswered.

I hope I am not the only one who thinks the hoa is bluffing him and will never follow through.

Unless the tow truck driver is there to repossess your vehicle at the request of the title holder it would be illegal for them to open your car door. It is not their property and opening the door would be equivalent to breaking and entering.
