Wasn't read my rights....

I was arrested last night for assault but was never read my right. I was only asked the standard questions of if I have anything sharp in my pockets. That is significant correct?

No. Despite what you might have watched on TV, a Miranda Warning only applies if questioning is to determine self incrimination.

You, trying to flex your 8" biceps whilst hitting away at an elderly woman in an attempt to steal three Sudafed? No questions of you will be needed, thus no Miranda. Now bend over & pick up the soap.

Typically in the real world, cops will question you first, then read you your rights and get you to sign a form stating that you were advised.

As to the sharp object question, there are 4 approaches:

1. the truth
2. no
3. silence
4. "just my nigger-gigger"

You're not in a position of strength of course.

It doesn't sound like they asked you anything of significance. You only need your rights read to you so that you don't say anything self incriminating.

Miranda only matters if you gave a confession you want to retract or said anything that could be used against you.

It is not a "get out of jail free" card if the police fail to read it to you.

And, if the first sentence does apply, who will the judge believe, you or the cops?

Any lawyer who says you have a chance of dismissal because of this is a liar.
