if it's prostitution is illegal in Fairfax county, why aren't daylaborers walking up and down the street illegal as well?

the police here probably won't tolerate hookers walking up and down the street
looking for customers, so why do the daylaborers get a break?

don't even get me started about the people who ask for donations while
standing in the middle of the intersection...(Rt 7 in Sterling, for example)

Walking up and down the street, for whatever reason, is not illegal. Hookers walk up and down the street all night and they are not arrested for walking up and down the street. They are only arrested for the actual soliciation or performance of prostitution. You can't arrest someone for walking down the street.

As for dayworkers, they are not breaking the law by using the sidewalk. If they are on private property, like a parking lot and the person or business doesn't want them there, they can have them arrested for trespassing. But even more so, soliciting employment isn't illegal. Otherwise every job interview would be a crime. As long as they aren't drunk or being disorderly, they are not breaking the law.
